The Eastern Side of Portion of Jubilee Avenue, the Western Side of Portion of Harbour View Road (now Marire Road), and the Northern Side of Portion of Hardington Street, in the Borough of Onehunga, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 10th day of October, 1928.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the Onehunga Borough Council on the thirtieth day of July and the tenth day of September, one thousand nine hundred and twenty-eight, respectively, viz.:

“That the Onehunga Borough Council, being the local authority having control of the streets in the Borough of Onehunga, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to those portions of streets known as Jubilee Avenue and Harbour View Road (now Marire Road) adjoining all that piece of land, being subdivision of Lots 1, 2, 3, 40, and 41 of a subdivision of Allotment 72, Small Lots, near Onehunga, and being the whole of the land described in Certificate of Title Vol. 35, folio 92, Auckland Register ”;

“The Onehunga Borough Council, being the local authority having control of the streets in the Town of Onehunga, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the street known as Hardington Street, adjoining Lots 1, 2, 3, 4, 5, being a subdivision of Lots 1, 2, 3, 40, and 41, of a subdivision of part of Allotment 72 of Small Lots, near the Town of Onehunga ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Jubilee Avenue, nor on the western side of the portion of Harbour View Road (now Marire Road), nor on the northern side of the portion of Hardington Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE eastern side of all that portion of street situated in the North Auckland Land District, Borough of Onehunga, known as Jubilee Avenue, adjoining a subdivision of Lots 1, 2, 3, 40, and 41, of a subdivision of Allotment 72, Small Lots, near Onehunga.

Also the western side of all that portion of street situated in the said land district and borough, known as Harbour View Road (now Marire Road), adjoining a subdivision of Lots 1, 2, 3, 40, and 41, of a subdivision of Allotment 72, Small Lots, near Onehunga.

Also the northern side of all that portion of street situated in the said land district and borough known as Hardington Street, adjoining a subdivision of Lots 1, 2, 3, 40, and 41 of a subdivision of Allotment 72, Small Lots, near Onehunga.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 72987, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Lemon Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

“That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that portion of the northern side of Lemon Street to which Section 989, New Plymouth, has frontage ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Lemon Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Lemon Street, fronting Section 989, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 73278, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Inspector of Scenic Reserves appointed.

CHARLES FERGUSSON, Governor-General.

IN pursuance and exercise of the powers conferred by section four of the Scenery Preservation Act, 1908, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby appoint

John Guthrie

to be an Inspector under the said Act in respect to the scenic reserves described in the Schedule hereto.

SCHEDULE.

WELLINGTON LAND DISTRICT.

SECTION 12, Block XV, Hautapu Survey District: Area, 89 acres 1 rood.

Also Section 12A, Block XV, Hautapu Survey District: Area, 11 acres 2 roods.

Also Section 42, Block XV, Hautapu Survey District: Area: 43 acres.

As witness the hand of His Excellency the Governor-General, this 8th day of October, 1928.
