said Act to the borrowing by the said local authority of the
said sum of four thousand pounds, at such rate or rates of
interest as shall not produce to the lenders a rate exceeding
the rate hereinafter mentioned :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by the said Act, and of all other powers
and authorities enabling him in this behalf, doth hereby
consent to the raising by the said local authority of the sum
of four thousand pounds at such rate or rates of interest as
shall not produce to the lenders a rate exceeding the rate of
six pounds per centum per annum, upon terms of making
the said sum, together with interest thereon, repayable by
instalments extending over a period of thirty-three years;
and the said Waipukurau Borough Council is hereby autho-
rized to borrow the said sum accordingly.

Fixing the Date and Place for the Payment of Land-tax and
Income-tax under the Land and Income Tax Act, 1923, and
the Land and Income Tax (Annual) Act, 1928.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
October, 1928.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authority
vested in him under the Land and Income Tax Act,
1923, and the Land and Income Tax (Annual) Act, 1928,
His Excellency the Governor-General of the Dominion of
New Zealand, acting by and with the advice and consent of
the Executive Council of the said Dominion, doth hereby
order and determine that the respective duties leviable under
the said Acts by way of land-tax and income-tax shall be
paid on the days and dates set forth hereunder :—
Land-tax under section 2 of the Land and Income Tax
(Annual) Act, 1928 : In one sum on Wednesday, the
seventh day of November, one thousand nine hundred
and twenty-eight.
Income-tax under section 3 of the Land and Income Tax
(Annual) Act, 1928 : In one sum on Friday, the eighth
day of February, one thousand nine hundred and twenty-
nine.
And, in further pursuance and exercise of the powers and
authority aforesaid, and with the like advice and consent as
aforesaid, His Excellency doth also determine that the place
where the said duties of land-tax and of income-tax shall be
payable shall be the office of the Commissioner of Taxes, at
the Government Buildings, Wellington, and that notice to
the aforegoing effect shall be given by the said Commissioner
accordingly.

Order in Council consenting to the Raising of a Loan of
£5,000 by the Kairanga County Council, and prescribing
Term and Rate of Interest.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
October, 1928.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Kairanga County Council (hereinafter
called “the said local authority”) is desirous of
raising the sum of five thousand pounds for the purpose of
widening and remetalling Foxton Line and Rangitikei Line,
and treating surface with tar and asphalt, by a loan to be
known as “Taonui Riding Road Improvements Loan, 1928” :
And whereas the said local authority has complied with the
provisions of the Local Government Loans Board Act, 1926
(hereinafter called “the said Act”), and it is expedient that
the precedent consent of the Governor-General in Council
under the said Act should be given to the raising of the said
loan on the terms and conditions hereinafter set forth :
And whereas the Minister of Finance has given his precedent
consent as required by section one hundred and fourteen
of the Local Bodies’ Loans Act, 1926, to the borrowing by the
said local authority of the said loan for the term hereinafter
mentioned, at such rate or rates of interest as shall not pro-
duce to the lenders a rate exceeding the rate hereinafter
mentioned :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by the said Act and by section one hundred
and fourteen of the Local Bodies’ Loans Act, 1926, and of all
other powers and authorities enabling him in this behalf,
doth hereby consent to the raising by the said local authority
of the said loan up to the amount of five thousand pounds
for a term of fifteen years, at such rate or rates of interest as
shall not produce to the lenders a rate exceeding the rate of
five pounds fifteen shillings per centum per annum, subject
to the condition that the said local authority shall, before
borrowing the said sum or any part thereof, make provision
for the repayment thereof by establishing a sinking fund under
the Local Bodies’ Loans Act, 1926, and by making to such
sinking fund payments at intervals of not more than one year
at a rate or rates which shall be not less than the rate of four
pounds twelve shillings and sixpence per centum, such pay-
ments to be made in respect of every part of the said sum for
the time being so borrowed and not repaid, and the first
payment to be made not later than one year after the first
day from which interest to the lender is computed on any
moneys so borrowed ; and subject to the further condition
that no portion of interest or sinking fund shall be paid out
of loan-money.

The Southern and Northern Sides of Portions of Wembley Street,
in the City of Christchurch, exempted from the Provisions of
Section 117 of the Public Works Act, 1908, subject to a Con-
dition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
October, 1928.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1908, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Christchurch City Council on the seventeenth
day of September, one thousand nine hundred and twenty-
eight, viz. :—
“The Christchurch City Council, having control of
Wembley Street, in the City of Christchurch, hereby
declares that the provisions of section one hundred and
seventeen of the Public Works Act, 1908, shall not apply to
the portion of the said street adjoining Lots 3, 4, 5, 6 (public
reserve, City Council’s property), 8, 9, 10, 11, 12, 13, 14,
15, 16, 17, 18, 19–20, 21, 22, and 23, as shown on deposit
plan No. 8976 ” ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
and northern sides of the portions of Wembley Street (described
in the Schedule hereto), within a distance of thirty-five feet
from the centre-line of the said portions of street.
SCHEDULE.
THE southern side of all that portion of street, in the Canter-
bury Land District, City of Christchurch, known as Wembley
Street, adjoining Allotments 13 to 23 (inclusive) on D.P. 8976,
being part R.S. 227, and the northern side of the portion of
the said street adjoining Allotments 3, 4, 5, and 6 (City
Council Reserve), and Allotments 8 to 12 (inclusive) on D.P.
8976, being part R.S. 227 : As the said portions of street are
more particularly delineated on the plan marked P.W.D.
73257, deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red and edged purple.
