ABSTRACT OF TERMS AND CONDITIONS OF LEASE.

  1. Tenders, accompanied by six months’ rent at the rate offered, £65 valuation for improvements, and £2 2s. (lease fee), to be addressed to the Commissioner of Crown Lands, Christchurch, and be marked on the outside “Tender for Reserve.”

  2. Possession will be given immediately on acceptance of tender.

  3. Term of lease, twenty-one years, with right of renewal for further similar terms at rentals based on fresh valuations under the provisions of the Public Bodies’ Leases Act, 1908.

  4. Rent payable half-yearly, in advance, on 1st day of January and July in each year.

  5. Lessee to maintain in good substantial repair all buildings, drains, and fences; to keep clear all creeks, drains, ditches, and watercourses; to trim all live hedges, and yield up all improvements in good order and condition at the expiration of his lease.

  6. Lessee not to transfer, sublet, or subdivide without the consent of the Land Board.

  7. Lessee to keep the land free from noxious weeds, rabbits, and vermin.

  8. Lessee not to use or remove any gravel without the consent of the Land Board.

  9. Lessee not to carry on any noxious, noisome, or offensive trade upon the land.

  10. Lessee not to make improvements without the consent of the Land Board.

  11. Lessee not to take more than three crops in succession, one of which must be a root crop; after the third crop the land to be left in pasture for at least three years; at least two-thirds of the area cropped to be left in pasture at the expiration of the term; penalty for breach, £2 per acre.

  12. Lessee not entitled to any compensation for improvements; but if the lease is not renewed upon expiration the new lease offered for disposal by public competition will be subject to payment by the incoming tenant of valuation for buildings and improvements effected by the original lessee with the consent of the Board; failing disposal, the land and buildings to revert to the Crown without compensation.

  13. Lease liable to forfeiture for non-payment of rent within six months after due date, or for breach of conditions.

  14. Land Board may resume not more than 5 acres for school-site upon reduction of rent and compensation for crops.

  15. Lessee to keep buildings insured.

  16. Lessee to have no right to any minerals.

Lands in Nelson Land District for Sale by Public Auction.

District Lands and Survey Office,
Nelson, 4th September, 1928.

NOTICE is hereby given that the undermentioned sections will be offered for sale by public auction for cash or on deferred payments at the District Lands and Survey Office, Nelson, at 2 o’clock p.m. on Tuesday, 9th October, 1928, under the provisions of the Land Act, 1924, and amendments.

SCHEDULE.

NELSON LAND DISTRICT.

Township of Takaka.

SECTION 14, Block X, Waitapu Survey District: Area, 9 perches. Upset price, £130.

Section 15, Block X, Waitapu Survey District: Area, 12·6 perches. Upset price, £150.

Section 16, Block X, Waitapu Survey District: Area, 12·9 perches. Upset price, £150.

Sections are situated with a frontage to Commercial Road, the main street of Takaka Township, and are suitable for business sites. Sections all have a frontage of 45·96 links to the main street.

TERMS OF PAYMENT.

Cash.—One-fifth of the purchase-money to be paid on the fall of the hammer; balance payable, together with £1 (Crown-grant fee), within thirty days thereafter.

Deferred Payments.—Five per cent. of purchase-money, together with £1 1s. (license fee), to be paid on the fall of the hammer.

The balance of the purchase-money, with interest thereon at the rate of 5½ per cent. per annum, to be paid by instalments extending over a period of 34½ years.

In addition to the prescribed half-yearly instalments the purchaser may, on making any such payment, pay any sum or sums, not less than £5 or multiple of £5, in reduction of the purchase-money.

Upon receipt of the final instalment, a certificate of title in respect of the land purchased shall issue, upon payment of the prescribed Crown-grant fee.

If the purchaser fails to make any of the prescribed payments by due date, whether of purchase-money or interest, the amount (if any) already paid shall be forfeited, and the contract for the sale be null and void.

Titles will be subject to Part XIII of the Land Act, 1924.

The lands are described for the general information of intending bidders, who are recommended, nevertheless, to make a personal inspection, as the Department is not responsible for the absolute accuracy of any description.

Settlement Land in Otago Land District for Selection on Renewable Lease.

District Lands and Survey Office,
Dunedin, 4th September, 1928.

NOTICE is hereby given that the undermentioned land is open for selection on renewable lease under the Land Act, 1924, and the Land for Settlements Act, 1925, and applications will be received at the District Lands and Survey Office, Dunedin, up to 4 o’clock p.m., on Thursday, 20th September, 1928.

Preference at the ballot will be given to landless applicants who have one or more children dependent on them; to landless applicants who, within two years immediately preceding date of ballot, have applied for land at least twice unsuccessfully; to applicants who have served beyond New Zealand as members of the Expeditionary Force; to persons engaged on military service beyond New Zealand in connection with the late war, if such persons immediately prior to the war were bona fide residents of New Zealand; and to applicants who, while domiciled in New Zealand, have served beyond New Zealand as members of any of His Majesty’s Forces in connection with any war other than the war with Germany.

SCHEDULE.

OTAGO LAND DISTRICT.—SETTLEMENT LAND.—FIRST-CLASS LAND.

Tuapeka County.—Waipahi Survey District.—Conical Hills Settlement.

SECTION 58A: Area, 285 acres 0 roods 12 perches. Capital value, £850. Half-yearly rental, £21 5s.

Weighted with £581 18s., valuation of improvements consisting of buildings, fencing, and grassing. This amount will be payable in cash or by a cash payment of £81 18s., and the balance on mortgage for a term of fifteen years with interest at the rate of 5½ per cent., plus a sinking fund. The improvements included in the capital value comprise fencing to the value of £15 14s.

Conical Hills Settlement is situated less than a mile to the north of the Township of Waipahi, and Section 58A has a frontage to the Waipahi River. The land is described as mixed agricultural and pastoral land of fair to good quality, mostly on a light clay subsoil. The railway-stations of Waipahi, Arthurton, and Pukerau, on the main south line, are within easy distance of the property. There are schools and post and telegraph offices at each of these places.

ABSTRACT OF CONDITIONS OF LEASE.

  1. Term of lease: Thirty-three years, with a perpetual right of renewal for further successive terms of thirty-three years, and a right to acquire the freehold.

  2. Rent: Five per cent. per annum on the capital value, payable in advance on 1st January and 1st July in each year.

  3. Applicants to be twenty-one years of age and upwards.

  4. Applicants to furnish with applications statutory declaration, and, on being declared successful, deposit £1 1s. (lease fee) and a half-year’s rent. Rent for the broken period between date of lease and 1st January or 1st July following is also payable.

  5. Applications made on the same day are deemed to be simultaneous.

  6. No persons may hold more than one allotment.

  7. Successful applicants to execute lease within thirty days after being notified that it is ready for signature.

  8. Lessee to reside continuously on the land, and pay all rates, taxes, and assessments.

  9. Transfer not allowed until expiration of fifth year of lease, except under extraordinary circumstances, and then only with permission.

  10. Lease is liable to forfeiture if conditions are violated.
