GISBORNE BOROUGH COUNCIL.

PURSUANT to section 13 of the Local Bodies’ Loans Act, 1926, I hereby give notice that at a poll of ratepayers of the Fox Street Special District of the Borough of Gisborne, taken on the 17th day of May, 1928, upon the proposal to borrow the sum of £1,200 for the purpose of installing a water-supply and sewerage system in the above special district, and the votes recorded respectively for and against the proposal were as follows: For the proposal, 9; against the proposal, 2.

I therefore declare the said proposal duly carried.

BANKS PENINSULA ELECTRIC-POWER BOARD.

In pursuance of section 13 of the Local Bodies’ Loans Act, 1926, I hereby notify that a loan proposal (sanctioned by the Loans Board) to raise a sum of £14,680 for development purposes in the Banks Peninsula Electric-power District was submitted to a poll of ratepayers on the 12th instant. The voting resulted as follows: For the proposal, 327; against the proposal, 90; informal, 10.

I hereby declare the said proposal to be carried.

Load-line Certificates issued by Portuguese Authorities to Portuguese Ships.

With reference to my despatch Dominions No. 107 of the 2nd March, I have the honour to transmit, for the information of His Majesty’s Government in New Zealand, the accompanying copies of an extract from the London Gazette of the 23rd March, containing an Order in Council of the 22nd March regarding the recognition of Portuguese load-line certificates.

Present:

The KING’S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by section 445 of the Merchant Shipping Act, 1894, it is enacted that where the Board of Trade certify that the laws and regulations for the time being in force in any foreign country and relating to overloading and improper loading are equally effective with the provisions of that Act relating thereto, His Majesty in Council may direct that on proof of a ship of that country having complied with those laws and regulations, she shall not, when in a port of the United Kingdom, be liable to detention for non-compliance with the said provisions of that Act, nor shall there arise any liability to any fine or penalty which would otherwise arise for non-compliance with those provisions:

And whereas by section 1 of the Merchant Shipping Act, 1906, provision, as is more particularly therein mentioned, is made for applying to foreign ships when in ports in the United Kingdom certain sections of the Merchant Shipping Act, 1894, which relate to load-line, without prejudice to any direction of His Majesty in Council given under the said section 445 of the last-mentioned Act:

And whereas the Board of Trade have certified that certain statutory regulations which have been approved by the Portuguese Government relating to overloading, so far as regards the assignment of load-lines to Portuguese ships are equally effective with the corresponding regulations in force in this country respecting the assignment of load-lines to British merchant ships:

Now, therefore, His Majesty in Council doth direct that on proof that Portuguese ships have complied with the aforesaid Portuguese regulations, such ships shall not, when in ports of the United Kingdom, be liable to detention for non-compliance with the provisions of the Merchant Shipping Acts relating to overloading, nor shall there arise any liability to any fine or penalty which would otherwise arise for non-compliance with those provisions.
