The Northern Side of Portion of Pendarves Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 10th day of May, 1928.
Present:
THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the second day of April, one thousand nine hundred and twenty-eight, viz.:-
"That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that portion of the northern side of Pendarves Street to which Sections 1626 and 1627, New Plymouth, have frontages";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Pendarves Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE northern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Pendarves Street, fronting Sections 1626 and 1627, Block V, Paritutu Survey District, Town of New Plymouth. As the said portion of street is more particularly delineated on the plan marked P.W.D. 72016, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.

Portion of Edwards Road, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the first day of March, one thousand nine hundred and twenty-eight, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz:-
"The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of street known as Edwards Road, adjoining Lot 31 of Block 54, Allotment 46, Section 8, Suburbs of Auckland";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
ALL that portion of street in the North Auckland Land District, City of Auckland, known as Edwards Road, adjoining Lot 31 of Block 54; Allotment 46 of Section 8, Suburbs of Auckland.

As the said portion of street is more particularly delineated on the plan marked P.W.D. 71445, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side generally of a Road, in the County of Waitemata, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitemata County Council on the sixteenth day of March, one thousand nine hundred and twenty-eight, the portion of road affected by such resolution being described in the Schedule hereto, viz.:-
"The Waitemata County Council hereby declares that section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that portion of the road fronting Lots 14 to 18 (inclusive) on a plan lodged in the Land Transfer Office at Auckland under Number 20087, being part of Allotments 35 and 35B of the Parish of Karangahape";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side generally of the road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said road.
SCHEDULE.
THE western side generally of all that road, situated in the North Auckland Land District, County of Waitemata, adjoining Lots 14, 15, 16, 17, and 18, D.P. 20087, being part Allotment 35, D.P. 10639, Parish of Karangahape. As the said portion of road is more particularly delineated on the plan marked P.W.D. 69333, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

A New Street, known as Chilton Road, in the Borough of Napier, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Napier Borough Council on the sixteenth day of April, one thousand nine hundred and twenty-eight, the street affected by such resolution being described in the Schedule hereto, viz.:-
"That the Council, being the local authority having control of the streets in the Borough of Napier, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the new street taken over by the borough passing through part of Suburban Section Number 46, Napier, containing by admeasurement 1 rood 21.66 perches, more or less, coloured pink on the plan marked P.W.D. 68501, and called Chilton Road";
