Recreation Reserve in Canterbury Land District brought under Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of May, 1928.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Canterbury Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of, and declared to be subject to the provisions of Part II of the said Act; and such reserve shall hereafter be known as the Lincoln Park Domain, and be managed, administered, and dealt with as a public domain.

SCHEDULE.

LINCOLN PARK DOMAIN.

ALL that area in the Canterbury Land District containing by admeasurement 10 acres, more or less, being Reserve No. 4200 (formerly part Lot 2, deposit plan No. 1788), situated in Block V, Halswell Survey District, and bounded as follows: Towards the west by Lot 4 on said deposit plan No. 1788, 1570·2 links; towards the north and east by other parts of Lot 2 on said deposit plan No. 1788, 636·9 and 1569·9 links respectively; and again towards the south by the Lincoln Town Belt, 636·9 links: As the same is more particularly delineated on the plan marked L. and S. 1/383, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

The Northern Side of Portion of Esplanade Road, in the Borough of Onehunga, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Onehunga Borough Council on the twenty-first day of November, one thousand nine hundred and twenty-seven, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz:—

“That the Onehunga Borough Council, having control of Esplanade Road in the Borough of Onehunga, fronting Lots 4, 5 and 6, D.P. 15911, by resolution hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said portion of the street”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the said portion of Esplanade Road (described in the Schedule hereto), within a distance of ten feet from the northern boundary thereof.

SCHEDULE.

THE northern side of all that portion of street, situated in the North Auckland Land District, Borough of Onehunga, known as Esplanade Road, adjoining Lots 4, 5, and 6, D.P. 15911. As the said portion of street is more particularly delineated on the plan marked P.W.D. 71037, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street off St. Leonard's Road, in the Borough of Mount Eden, of a Width less than 66 ft. but not less than 50 ft.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of May, 1928.

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1920, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Mount Eden Borough Council to permit the laying-off of the street described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty feet, it being inexpedient to lay off such street of a width of sixty-six feet.

SCHEDULE.

THAT street off St. Leonard's Road in the North Auckland Land District, Borough of Mount Eden, through part Allotment 76 of Section 10, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 71223, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

A new Street connecting Seddon Street and Kitchener Square, in the Borough of Timaru, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 10th day of May, 1928.

Present :

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Timaru Borough Council on the thirtieth day of April, one thousand nine hundred and twenty-eight, the street affected by such resolution being described in the Schedule hereto, viz.:—

“That the Timaru Borough Council, being the local authority having control of the streets in the Borough of Timaru, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that street connecting Seddon Street and Kitchener Square, in the Canterbury Land District, Borough of Timaru, containing by admeasurement 3 roods 8·6 perches, more or less, through Lot 1, D.P. 495, and through Lot 55, D.P. 2029, which street comprises part of the land in Certificates of Title Register-book, Vol. 403, folio 189, and Vol. 219, folio 65, and is Lots 24 and 25, D.P. 8842”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street (described in the Schedule hereto), within a distance of forty feet from the centre-line of the said street.

SCHEDULE.

ALL that new street, situated in the Canterbury Land District, Borough of Timaru, connecting Seddon Street and Kitchener Square through Lot 1, D.P. 495, and Lot 55, D.P. 2029. As the said street is more particularly delineated on the plan marked P.W.D. 71316, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
