Allocating Cost of certain Proceedings under Section 132 of the Municipal Corporations Act, 1920, Borough of Wairoa.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 29th day of March, 1928.

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.
IN pursuance of the powers vested in him by section one hundred and thirty-two of the Municipal Corporations Act, 1920, and of every other power and authority enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct that the Wairoa Borough Council and the Wairoa County Council shall defray in equal proportions, all the costs of the Commission appointed under the said Act by a Warrant under the hand of His Excellency the Governor-General dated the eighteenth day of January, one thousand nine hundred and twenty-eight, to inquire and report upon the proposal contained in the petition of J. S. Black and others to exclude a certain area from the Borough of Wairoa and to include such area in the County of Wairoa.

Amendments to the Regulations under the Government Railways Act, 1926.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 4th day of April, 1928.
Present:
THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred upon him by the Government Railways Act, 1926, and the Government Railways Amendment Act, 1927, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the regulations made under the Government Railways Act, 1908 (now the Government Railways Act, 1926), on the twelfth day of June, one thousand nine hundred and twenty-two, by making the following alterations therein:-
(a) By omitting Regulation 42.
(b) By omitting from Regulations 43, 44, and 45 the words "or Assistant Engineer" wherever such words occur therein.
(c) By omitting from subparagraph iv of paragraph (c) of Regulation 49, the words "Subject to the provisions of Regulation 62."
(d) By omitting Regulation 62.
(e) By adding the following Regulation 173A:--
"The Permanent Head shall appoint a member of the Department to be Secretary to the Appeal Board."
(f) By omitting Regulation 174.
(g) By adding in Regulation 175, after the figures 175, the figure (1).
(h) By adding to Regulation 175 the following paragraphs:--
(2) The Permanent Head shall, with all convenient speed, forward the appeal, together with his answer thereto, to the Secretary to the Appeal Board.
(3) The Secretary to the Appeal Board shall immediately forward the appeal together with the answer of the Permanent Head to the Chairman of

the Appeal Board, who shall fix a time and place for the hearing of the appeal, and shall notify the Permanent Head of such time and place. The Permanent Head shall thereupon cause notice accordingly to be given to the other members of the Board and to the parties directly interested, including witnesses who are members of the Department: Provided, however, that if in such answer the Permanent Head intimates that the Government Railways Board offers no objections to the appeal being allowed, the Appeal Board may allow the appeal without calling for the attendance of the appellant.
(4) The Secretary to the Appeal Board shall forward to the Permanent Head the decision of the Board, and to the appellant a copy of such decision.
(i) By adding the following Regulation 175A:--
"If in any case the Permanent Head is of opinion that no ground of appeal exists he shall forward the notice of appeal to the Appeal Board, with an intimation to that effect, setting out his reason or reasons for such opinion, and if the Appeal Board concurs in such opinion the appellant shall be notified accordingly. If in any such case the Appeal Board considers there is a ground of appeal, the matter shall be referred to the Solicitor-General for an opinion."
This Order in Council shall be deemed to apply to every appeal lodged but not heard by the Railway Appeal Board at the date of the said Order in Council.

Amending Description of Taihape Domain, Wellington Land District.

WHEREAS by an Order in Council dated the thirty-first day of July, one thousand nine hundred and twenty-two, and gazetted on the third day of August, one thousand nine hundred and twenty-two (hereinafter referred to as "the said Order in Council") a Domain Board was appointed to have control of the Taihape Domain:
And whereas an error was made in the description of the said domain in the Schedule to the said Order in Council by the omission therefrom of the land described in the Schedule hereto, and it is expedient that this error should be rectified:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred upon him by the Public Reserves and Domains Act, 1908, and of every other power and authority enabling him in this behalf, doth hereby amend the Schedule to the said Order in Council by adding thereto the land described in the Schedule hereto.

WELLINGTON LAND DISTRICT.
SECTION 21, Block II, Town of Taihape: Area, 1 rood 16 perches, more or less.
