subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Scherff Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Scherff Road, fronting Lot 84, D.P. 366, being part Allotment 5, Section 16, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 69342, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Land District, and thereon coloured red.

At the Government Buildings at Wellington, this 28th day of November, 1927.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Devonport Borough Council on the seventh day of September, one thousand nine hundred and twenty-seven, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz. :—

“ That the Devonport Borough Council, being the local authority having control of streets in the Borough of Devonport, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of Church Street fronting Lots 1–4 of Lot 3 of Allotment 6, Section 2, Parish of Takapuna ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the said portion of Church Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

THE north-eastern side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Church Street, adjoining Lots 1 to 4 of Part Lot 3 of Allotment 6, Section 2, Parish of Takapuna. Vesting the Control of a Gravel Reserve in the Westport Borough Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 28th day of November, 1927.

Present :

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart for gravel purposes: And

whereas it is expedient that the control of the said reserve should be vested in the Westport Borough Council :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section two of the Public Reserves and Domains Amendment Act, 1914, doth hereby vest the control of the said reserve in the Westport Borough Council.

SCHEDULE.

ALL that area in the Nelson Land District, containing 10 acres, more or less, being part Section 130, Block III, Kawatiri Survey District ; as the same is more particularly delineated on the plan marked L. and S. 5416, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered blue.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 28th day of November, 1927.

Present :

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924 :

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that part of the Rotoroa Kauri-gum Reserve as described in the Schedule hereto be exempted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation :

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that part of the Rotoroa Kauri-gum Reserve, as described in the Schedule hereto, shall from the twelfth day of December, one thousand nine hundred and twenty-seven, cease to be subject to the Kauri-gum Industry Act, 1908.

ALL that area in the North Auckland Land District, containing by admeasurement 29 acres 2 roods 31·5 perches, more or less, being part of Rotoroa Kauri Gum Reserve, Block VII, Opoe Survey District, Mangonui County, as the same is more particularly delineated on the plan marked L. and S. 22/1747, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
