of three thousand one hundred pounds (£3,100) for the purpose of laying a four-inch (4 in.) water-main, with all necessary valves, fire-plugs, and accessories in Ridge Road, commencing at a point near to the intersection of Carlton Street with Ridge Road and terminating at the vehicular turn in Cape Horn Road, for a water-supply to the Wesley Training College lands :

And whereas the said loan is for the benefit of the defined portion of the Mount Roskill Road District described in the said special order (hereinafter referred to as the “special-rating area”).

And whereas the proceedings in connection with the raising of the said loan were irregular or defective in that—

(a) In the said special order reference was made to section sixteen of the Local Bodies’ Loans Act, 1913, instead of to section seventeen of the Local Bodies’ Loans Act, 1926 :

(b) Notification of the deposit of the special roll was not inserted in a newspaper circulating in the district, as required by section three of the said Act :

And whereas it appears that the ratepayers of the special-rating area have not been misled by such irregularities as aforesaid, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by section one hundred and twenty-two of the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though—

(a) The said Act and section seventeen thereof had been correctly referred to in the said special order :

(b) Notification of the deposit of the special poll had been published as required by the said Act.

And that the validity of the proceedings in connection with the said loan, or of the security for the said loan shall not be called in question by reason only of the irregularities or defects aforesaid.

Amending Order in Council regulating the Use of Nets for taking Fish in certain Waters.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 28th day of November, 1927.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the thirtieth day of August, one thousand nine hundred and twenty-six, published in the New Zealand Gazette No. 59 of the second day of the following month, regulations were made regulating the use of nets for taking fish in certain waters :

And whereas it is desirable to amend the said regulations in the manner hereinafter described :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by section five of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke paragraph (d) of the First Schedule to the hereinbefore-recited regulations, and doth hereby substitute the following paragraph in lieu thereof:—

(d) All that area of tidal land and tidal water inside straight lines drawn from Puri Point to Epuni Point, from the western extreme of Wai Hau Island to the eastern extreme of Tuhina Islet; thence to the northern extreme of Rangipukea Island, and from the southern extreme of Rangipukea Island to Deadman Point: As the said area is shown and delineated, coloured blue, on plan marked M.D. 6428, and deposited in the office of the Marine Department, at Wellington.

Vesting the Control of Scenic Reserves in the Hundalee Scenic Reserves Board.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being lands reserved under the said Act) for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—

The Commissioner of Crown Lands, Blenheim, ex officio,

The Chairman, Kaikoura County Council, ex officio,

The President, Canterbury Automobile Association, ex officio,

Robert Lanktree Withers,

John Gilman Sharp Dunn, and

John Trewin,

who are hereby constituted for that purpose a special Board by the name of the Hundalee Scenic Reserves Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—

  1. The first meeting of the Board shall be held on Wednesday, the seventh day of December, one thousand nine hundred and twenty-seven, at two o’clock p.m., in the County Council Office, Kaikoura, and thereafter the Board shall meet for the transaction of business on the first Wednesday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

  2. The Commissioner of Crown Lands shall be the Chairman of the Board. He may join in the discussion, and shall have an original as well as a casting vote.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be chairman for such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board may, with the approval of the Minister in Charge of Scenery Preservation, make such rules as it deems necessary for the good conduct of the public frequenting the reserves, and may set apart areas for camping-grounds or other purposes, and may fix reasonable charges for the use thereof in accordance with a scale to be approved from time to time by the Minister.

  9. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

  10. The Board shall control the said reserves in accordance with the provisions of the said Act and of the regulations made thereunder.
