Exempting Crown Land in Cromwell Survey District from Mining under the Mining Act, 1926.

CHARLES FERGUSSON, Governor-General.

WHEREAS by section twenty of the Mining Act, 1926, it is, inter alia, enacted that the Governor-General may from time to time, by notice in the Gazette, exempt any Crown lands from mining, or from any specified mining purpose, or from that Act, or any specified provisions of that Act; and that the lands to which any such notice relates shall be specified therein by words of particular description: And whereas it is desirable that the Crown land specified in the Schedule hereto shall, subject to all existing registered mining privileges, be exempted from mining: Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by section twenty of the Mining Act, 1926, and of all other powers and authorities in anywise enabling me in that behalf, do hereby exempt the land particularly described in the Schedule hereto from mining under the provisions of that Act, subject to all existing registered mining privileges; and do also hereby declare that such exemption shall take effect from the date of the gazetting hereof.

SCHEDULE.

ALL that area of land in the Provincial District of Otago containing by admeasurement 44 acres, being Crown land in Blocks II and IV, Cromwell Survey District. Commencing at a point distant 19821·1 links south and 3722·1 links west of Trig. “G,” and bounded thence towards the north by Crown lands, 350 links, bearing 230 degrees 42 minutes; towards the west by Crown lands, 2500 links, again towards the north by Crown lands, 600 links, bearing 90 degrees, again towards the west by Crown lands, 3575 links, bearing 180 degrees; towards the south by Crown lands, 550 links, bearing 90 degrees, and 400 links bearing 253 degrees 6 minutes, and finally towards the east by Crown lands, 7400 links, to the commencing-point: Be all the aforesaid area and linkages a little more or less. As the same is more particularly delineated on the plan numbered N.10/17/38, and deposited in the Head Office of the Mines Department, at Wellington, and thereon bordered red.
