Vesting Control of a Recreation Reserve under the Tourist and Health Resorts Control Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of October, 1927.

Present:

His Excellency The Governor-General in Council.

IN pursuance and exercise of the power and authority conferred on him by section five of the Tourist and Health Resorts Control Act, 1908 (hereinafter termed "the said Act"), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the recreation reserve, described in the Schedule hereto, in the Minister of the Crown for the time being having the administration of the said Act, and doth hereby declare that the said reserve shall be administered under the said Act.

SCHEDULE.

ALL that area in the Canterbury Land District containing by admeasurement 18,900 acres, more or less, being Reserve No. 4174, situated in Blocks II, III, IV, VII, VIII, and IX of Torlesse Survey District, and Blocks I and IV, Cook Survey District, and Blocks I and II of Godley Survey District, and bounded as follows: Commencing at a point on the boundary between the Land Districts of Canterbury and Westland and being the summit of McClure Peak; thence southerly along the western boundary of the Ashburton County to its junction with the northern boundary of Run No. 78; thence westerly along the said boundary to a point due west of Trig. Station L; thence due west to a point on the eastern boundary of Run No. 80; thence north-westerly, southerly, and easterly to a point opposite the easternmost extremity of Reserve No. 2756; thence due west to the said easternmost extremity of Reserve No. 2756; thence north-westerly along the north-eastern boundary of the said reserve to the boundary between the Land Districts of Canterbury and Westland as aforesaid; thence north-easterly along the said boundary to the point of commencement: as the same is more particularly delineated on the plan marked L. and S., 8/8/76, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Revoking Order in Council licensing the New Zealand Co-operative Dairy Company, Limited, to use and occupy a Part of the Foreshore and Land below Low-water Mark at Netherton, on the Waihou River, Thames, as a Site for Wharves.

WHEREAS by Order in Council dated the eighteenth day of May, one thousand nine hundred and twenty-five, and published in the New Zealand Gazette No. 38 of the twenty-first day of the same month, the New Zealand Co-operative Dairy Company (Limited), (who, with its successors and assigns, is hereinafter called "the company"), was licensed to use and occupy a part of the foreshore and land below low-water mark at Netherton, on the Waihou River, Thames, as a site for wharves:

And whereas the said company has applied to have the hereinbefore-recited license revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the eighteenth day of May, one thousand nine hundred and twenty-five, as from the thirty-first day of August, one thousand nine hundred and twenty-seven.

Prescribing the Term for which the Patea Borough Council may borrow the Sum of Β£2,500, authorized to be raised for the Purpose of repaying a Matured Loan, and also the Rate of Interest payable thereon.

At the Government House at Wellington, this 10th day of October, 1927.

Present:

His Excellency The Governor-General in Council.

WHEREAS by section one hundred and fourteen of the Local Bodies' Loans Act, 1926, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority or public body may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council:

And whereas the Patea Borough Council has been authorized to borrow the sum of two thousand five hundred pounds for the purpose of repaying a matured loan:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section one hundred and fourteen, and it is desired that the term for which the money may be borrowed be twenty-six years, and the rate of interest payable thereon be not exceeding six per centum per annum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Patea Borough Council may borrow the said sum of two thousand five hundred pounds shall be twenty-six years, and the rate of interest that may be paid thereon shall be a rate not exceeding six per centum per annum, and the said Patea Borough Council is hereby authorized to borrow the said sum of two thousand five hundred pounds accordingly.
