Apportioning the Cost of Maintenance, &c., of Portion of Hokio Stream in the County of Horowhenua.

A PROCLAMATION.
WHEREAS under the provisions of section sixty-five of the Land Drainage Act, 1908 (hereinafter referred to as “the said Act”), a Commission was appointed and an inquiry was duly held with a view to determining what local authority could most conveniently and efficiently control the Hokio Stream, in the County of Horowhenua (hereinafter referred to as “the stream”), and what proportion of the cost of maintaining, repairing, improving, or reconstructing the stream should be paid by any, and, if so, which, local authority or local authorities:
And whereas such Commission did report to the Governor-General, after due inquiry, its opinion as to the matters respecting which it was appointed to report:
And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:
Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct as follows, that is to say:—

Subject to the provisions hereinafter mentioned and to section fifty-three of the Local Legislation Act, 1926, that portion of the stream described in the Schedule hereto (hereinafter referred to as “the said area”) shall be under the exclusive care, control, and management of the Hokio Drainage Board (hereinafter referred to as “the Drainage Board”).

The cost of maintaining, repairing, improving, or reconstructing the said area shall be provided and paid by the Drainage Board.

The Horowhenua County Council (hereinafter referred to as “the County Council”) shall pay annually to the Drainage Board the sum of ten pounds (£10) towards the cost of maintaining, repairing, improving, or reconstructing the said area: Provided that if in any year the County Council expends any sum for the improvement of any portion of the stream between the said area and the sea then the said payment of ten pounds (£10) shall be reduced in that year by the amount so expended.

I direct that any payment hereby required to be made as aforesaid by the County Council shall be paid from time to time, in the amounts hereinbefore fixed and determined, out of the funds under the control of the County Council, within a period of thirty days after demand in writing made by or on behalf of the Drainage Board; and all such payments shall be made from time to time to the Clerk of the Drainage Board, for and on account of such Drainage Board.

In the exercise of the powers conferred by this Proclamation the Drainage Board shall take all reasonable steps to safeguard and preserve any Native fishing rights conferred by the Horowhenua Block Act, 1896, and any rights of user of the Horowhenua Lake as a public recreation reserve under the Horowhenua Lake Act, 1905; and for that purpose—
(a.) It shall not be lawful for the Drainage Board to deepen or to do any acts likely to deepen the said area without the consent of a majority of the Native owners of adjoining property. In the event of such consent not being given, the Minister of Internal Affairs, on the request of the Drainage Board, if after due inquiry he is satisfied that the said area should be deepened, may authorize the Drainage Board to deepen the said area accordingly.
(b.) The Drainage Board shall repair or replace any eel-weirs that are damaged or removed by it in the execution of works in the said area or, in the alternative, it may pay to the Native owners of such eel-weirs reasonable compensation for such damage or removal.

SCHEDULE.
DESCRIPTION OF PORTION OF HOKIO STREAM.
ALL that portion of the Hokio Stream situated in Block IV, Moutere, and Block II, Waitohu Survey Districts, Wellington Land District, commencing at a line drawn across the said stream from the south-western corner of Horowhenua XI B 41 North Block, Subdivision D 1, being the production of the western boundary-line of the said subdivision, and terminating at a line drawn across the aforesaid stream between the south-western corner of Horowhenua XI B 41, North Block,
Subdivision B 1, and the easternmost corner of Raumatangi Block, Subdivision A.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 6th day of December, 1926.

Revoking the Reservation over Portion of a Scenic Reserve in the Auckland Land District.

A PROCLAMATION.
WHEREAS by Order in Council dated the twenty-fourth day of March, one thousand nine hundred and ten, and gazetted on the thirty-first day of that month, and by Proclamation dated the twenty-ninth day of November, one thousand nine hundred and eleven, and gazetted on the seventh day of December, one thousand nine hundred and eleven, certain lands in the Auckland Land District were taken for scenery-preservation purposes under the provisions of the Public Works Act, 1908, the Scenery Preservation Act, 1908, and the Scenery Preservation Amendment Act, 1910:
And whereas the land described in the Schedule hereto (being part of the land so taken) is no longer suitable for scenic purposes owing to the absence of scenic bush thereon:
Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on me by section eight of the Scenery Preservation Amendment Act, 1910, do hereby revoke the reservation for scenic purposes over the land described in the Schedule hereto.

SCHEDULE.
ALL that area in the Auckland Land District containing 25 acres 2 roods 25 perches, more or less, being Section 4, Block X, Rotorua Survey District. Bounded towards the north by a public road 483·9, 597·1, 808·4 and 78·4 links; towards the east generally by Rotorua Block, 1419·1 and 736·8 links; and towards the south-west generally by Scenic Reserve 1024·9, 255·5, 370·1, 500·5, 520·9, 381·2, 344, 208·7, 176·9, 157, and 120·4 links: be all the aforesaid linkages a little more or less. As the same is more particularly delineated on the plan marked L. and S. 4/358A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Auckland Plan No. 24280, blue.)

Defining the Middle-line of a Road in Block XI, Rotorua Survey District—viz., a Deviation of the Cambridge-Rotorua Main Highway.

A PROCLAMATION.
IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1908, the Public Works Amendment Act, 1923, and of every other power and authority in anywise enabling me in this behalf, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the middle-line of a road desired to be constructed over Block XI, Rotorua Survey District—viz., a deviation of the Cambridge-Rotorua Main Highway—shall be that defined and set forth in the Schedule hereto.
