him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct that the Mataura Borough Council and the Southland County Council shall defray in equal proportions all the costs of the Commission appointed under the said Act by Warrants under the hand of His Excellency the Governor-General dated the sixteenth day of January, one thousand nine hundred and twenty-five, the fourteenth day of March, one thousand nine hundred and twenty-five, and the twenty-second day of May, one thousand nine hundred and twenty-five, to hold an inquiry and make a report on the proposal to exclude a certain area from the Borough of Mataura and include such area in the County of Southland.

Amending Description of Hamilton Domain, Auckland Land District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 27th day of January, 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS by an Order in Council dated the twentieth day of December, one thousand nine hundred and twenty, and gazetted on the thirteenth day of January, one thousand nine hundred and twenty-one (hereinafter referred to as “the said Order in Council”) a Domain Board was appointed to have control of the Hamilton Domain:

And whereas an error was made in the description of the said domain in the Schedule to the said Order in Council by the omission therefrom of the lands described in the Schedule hereto, and it is expedient that this error should be rectified:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred upon him by the Public Reserves and Domains Act, 1908, and of every other power and authority enabling him in this behalf, doth hereby amend the Schedule to the said Order in Council by adding thereto the lands described in the Schedule hereto.


SCHEDULE.

ALL those areas in the Auckland Land District, containing by admeasurement 6 acres 0 roods 19·7 perches, more or less, being portions of the Hamilton Domain, and being more particularly described as follows:—

Firstly, 1 rood 8·3 perches, more or less. Bounded—commencing at the intersection of the north-eastern side of Seddon Road with the southern side of the Auckland-Rotorua Railway Reserve—towards the north-west by that reserve, 54·6 links; towards the north-east by Section 11, Hamilton West Town Belt, 593 links; towards the south-east by Ward Street, 50 links; and towards the south-west by Seddon Road, 615·2 links, to the point of commencement: be all the aforesaid linkages a little more or less. As the same is delineated on a plan marked L. and S. 1/178, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Secondly, 2 acres 1 rood 36·4 perches, more or less. Bounded—commencing at the south-western corner of Section 14A, Hamilton West Town Belt—towards the north-east and north generally by the said Section 14A and 14 of the Town Belt, 50 links, 177·5 links, and 765 links; towards the south-east by Hill Street, 166 links; towards the south-south-west, and south-east generally by Section 15 of the Town Belt, 730 links, 209·5 links, and 665 links; towards the south-west by a public road, 150·5 links; towards the north-west by Lots 12, 6, and 8 on D.P. 13813, 655·9 links; towards the north-east by Seddon Road, 100 links; and towards the north-west by Seddon Road, 150 links, to the point of commencement: be all the aforesaid linkages a little more or less. As the same is delineated on a plan marked L. and S. 1/178, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Thirdly, 3 acres 1 rood 15 perches, more or less. Bounded—commencing at the south-western corner of Section 457, Town of Hamilton West—towards the north-east generally by the said Section 457, 501 links; the abutment of Richmond Street, 100 links; Sections 213, 214, 215, 216, 217, 218, Town of Hamilton West, 1098 links; the abutment of Abbotsford Street, 100 links; by Hinemoa Street, 1102·7 links; the abutment of Mill Street, 100 links; and by Section 6 of the Town Belt, 410 links; towards the south-east by Liverpool Street, 101·6 links; towards the south-west generally by part of Section 4 of the Town Belt, 381 links; the abutment of a road, 2·2 links and 106·2 links; by other part of said Section 4 and by 3, 2, and 1 of the Town Belt to the Waitawhiriwhiri Stream, 2782 links; and towards the west by that stream to the point of commencement: be all the aforesaid linkages a little more or less. As the same is delineated on a plan marked L. and S. 1/178, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Amending Rules of Native Land Court.

ORDER IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by the Native Land Act, 1909, and its amendments, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order that the Rules of Court made on the twenty-fourth day of August, one thousand nine hundred and fourteen, and gazetted on the twenty-seventh day of August, one thousand nine hundred and fourteen, be and the same are hereby amended, varied, or revoked as herein set forth.


RULES.

  1. RULE 89 is hereby amended by omitting the words “not being earlier than twenty-eight days after the date of the Order by which the time is so appointed.”

  2. Rule 90 is revoked.

Amending Regulations for the Occupation of Pastoral Lands within the Karamea and Westland Mining Districts.

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section three of the Land Act, 1924, and by section thirty-eight of the Mining Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend in the manner set forth in the Schedule hereto the regulations for the occupation of pastoral lands within the Karamea and Westland Mining Districts (hereinafter referred to as “the said regulations”) made on the twenty-sixth day of March, one thousand nine hundred and thirteen, and published in the Gazette of the third day of April, one thousand nine hundred and thirteen.


SCHEDULE.

  1. THE said regulations are hereby amended by adding after clause 8 thereof the following new clause:—

“8A. (a.) Notwithstanding anything with respect to the term or renewal of licenses contained in the regulations for the occupation of pastoral lands within the Westland Mining District made on the twenty-second day of October, one thousand nine hundred and three, and published in the Gazette of the twenty-ninth day of October, one thousand nine hundred and three, the provisions of clause eight hereof shall be deemed to apply to any license issued pursuant to any such revoked regulations and to the owner of any such license.

“(b.) Where, with respect to the determination of the rent of a renewed license, it is found impracticable to cause the necessary valuations to be made within the proper time pre-
