The Southern Side of Portion of Alexander Street, in the Borough of Devonport, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of January, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Devonport Borough Council on the twenty-ninth day of July, one thousand nine hundred and twenty-five, in so far as it effects Alexander Street, viz. :—

“ That the Devonport Borough Council, having control of streets known as Spring Street and Alexander Street, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the said streets fronting on Allotments 25, 26, and 27, of Lot 24A, Section 2, Parish of Takapuna, owned by Mr. W. Bond ” ;

such portion of street being described in the Schedule hereto.

SCHEDULE.

THE southern side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Alexander Street, fronting Allotments 25, 26, and 27 of Lot 24A, Section 2, Parish of Takapuna. As the said portion of street is more particularly delineated on the plan marked P.W.D. 63656, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red and edged blue.

The North-eastern Side of Portion of Glen Road, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 18th day of January, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of September, one thousand nine hundred and twenty-five, viz. :—

“ That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to those portions of the north-eastern side of that street in the City of Dunedin known as Glen Road, where the same abut on part of Section 5, Block VI, Town District, as the said portions of the said street are more particularly shown by brown colour on the plan hereunto annexed ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Glen Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Glen Road, fronting Part Section 5, Block VI, Town District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 64198, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured brown.

The Western Side of Portion of Sackville Street, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the twelfth day of November, one thousand nine hundred and twenty-five, viz. :—

“ That the Auckland City Council, having control of Sackville Street, Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said street, fronting Lots 2 and 3 of Lot 7 and part Lot 8 of Allotment 43, Section 8, Suburbs of Auckland ” ;

such portion of street being described in the Schedule hereto.

SCHEDULE.

THE western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Sackville Street, fronting Lots 2 and 3 of Lot 7 and part Lot 8 of Allotment 43, Section 8, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 64831, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

Validating Election of Trustees of Eltham Drainage District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 12th day of January, 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS pursuant to section ten of the Land Drainage Act, 1908 (hereinafter referred to as “ the said Act ”), and pursuant to an Order in Council made on the twenty-seventh day of April, one thousand nine hundred and one, and gazetted on the second day of May, one thousand nine hundred and one, an election of five Trustees of the Eltham Drainage District (hereinafter referred to as “ the said district ”) should have been held on the fifth day of November, one thousand nine hundred and twenty-three, and such election was not held on that day, but public notice was given that an election (hereinafter referred to as “ the said election ”) would be held on the sixteenth day of November, one thousand nine hundred and twenty-five :

And whereas five candidates were nominated for election as trustees of the said district, and the five candidates so nominated were declared to be duly elected as Trustees of the said district accordingly :

And whereas it is expedient to validate the holding of the said election after the day provided by the said Act :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by the said Act as amended by the Land Drainage Amendment Act, 1922, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said election of Trustees of the said district insofar as that election was not held on the day provided by the said Act ; and doth hereby declare that the proceedings in connection with the holding of the said election shall not be called in question by reason only of the irregularity aforesaid.
