Amending an Order in Council authorizing the Motueka Borough Council to erect Electric Lines in the Borough of Motueka.

ORDER IN COUNCIL.
At the Government House at Wellington, this 23rd day of April, 1926.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by the Public Works Amendment Act, 1911, and of every other power enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the twenty-seventh day of April, one thousand nine hundred and twenty-one, and published in the New Zealand Gazette No. 43, of the fifth day of May, one thousand nine hundred and twenty-one, authorizing the Motueka Borough Council to erect electric lines in the Borough of Motueka, by revoking clause 4 thereof (Charges for electrical energy), and substituting therefor the following clause, viz. :—

“4. CHARGES FOR ELECTRICAL ENERGY.

“The charge for electrical energy shall not exceed 1s. 2d. per unit for lighting purposes, and 4d. per unit for motor-power, heating, or cooking purposes; provided that ‘lighting purposes’ shall include the operation of motor-generators for lighting purposes; and provided also that the charge for lighting shall be subject to a discount of 2d. per unit if accounts are paid by consumers within fourteen days from the date of rendering such accounts by the licensee.”

An Unnamed Road off Wall Road, in the One Tree Hill Road District, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 20th day of April, 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the One Tree Hill Road Board on the seventeenth day of March, one thousand nine hundred and twenty-six, viz. :—

“That the One Tree Hill Road Board, being the local authority having control of that street at present unnamed, but situated fronting Lot one and part of Lots two and six on a plan deposited in the Land Registry Office at Auckland under Number 18648, which said piece of land is portion of Allotment one of Section seventeen of the Suburbs of Auckland, which said street meeting Wall Road at right angles on its western side, and being the strip of road coloured red and shown on the plan annexed hereto, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to any portion of the above street ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of the said road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said road.

SCHEDULE.

ALL that unnamed road situated in the North Auckland Land District, One Tree Hill Road District, off Wall Road, adjoining Lot 1 and part Lots 2 and 6, D.P. 18648, being part of Allotment 1 of Section 17 of Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 64440, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon edged red.

Consenting to Bodies Corporate borrowing Money and authorizing Payment to Committees of Management.

At the Government Buildings at Wellington, this 20th day of April 1926.

Present:

THE RIGHT HONOURABLE J. G. COATES, P.C., PRESIDING IN COUNCIL.

WHEREAS by section three hundred and thirty-five of the Native Land Act, 1909, it is provided that, with the precedent consent of the Governor-General in Council, a body corporate constituted under Part XVII of the said Act may, on the security of a mortgage or charge of the land vested in it, borrow money for any of the purposes therein mentioned :

And whereas the bodies corporate constituted as aforesaid described in the Schedule hereto have applied for the precedent consent of the Governor-General in Council accordingly, and also that consent be given to any money so borrowed being paid to the committees of management of such bodies corporate :

And whereas the Tairawhiti District Maori Land Board has recommended that such consent be granted, and it seems expedient so to do :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby, pursuant to section three hundred and thirty-five of the Native Land Act, 1909, and all other powers him enabling, grant precedent consent to the said bodies corporate, on the security of a mortgage or charge of the lands vested in them, borrowing money from a State Loan Department or from any person or body corporate, whether by cash credit in current account with a bank or otherwise, for the purpose of enabling the said bodies corporate to liquidate existing liabilities in respect of, and to further improve and more efficiently farm, the lands of the said bodies corporate, the sums set out hereunder opposite the name of each such body corporate; and doth authorize the payment of any money so borrowed to the respective committees of management of the said bodies corporate.
