Amending Regulations under the Fisheries Act, 1908.

WHEREAS by Order in Council dated the twenty-third day of May, one thousand nine hundred and six, and published in the New Zealand Gazette No. 41, of the thirty-first day of the same month, regulations were made with respect to oysters, fish, and seals inhabiting the waters in the Dominion of New Zealand:

And whereas it is desirable to amend the said regulations in the manner hereinafter described :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by the Fisheries Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend clause twenty-eight of the hereinbefore-recited regulations by revoking the following words : “This regulation shall have force and effect within the Provincial District of Auckland and the waters thereof.”

Authorizing the Minister of Public Works to construct and maintain Water-supply Works in the Tarras Irrigation District.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is provided by section two of the Public Works Amendment Act, 1910 (hereinafter called “the said Act”), that the Governor-General may, if he thinks fit, by Order in Council, authorize the Minister of Public Works to construct, maintain, or control any water-race or water-supply works, either within or outside a mining district, which are proposed to be constructed or which have been constructed out of funds provided by Parliament :

And whereas it is further provided by section five of the said Act that before any Order in Council is issued authorizing the said Minister to construct any water-race or water-supply works the owners or occupiers of all the lands likely to be benefited thereby shall be given an opportunity to enter into contracts with His Majesty to take water from such works when completed; and such contracts shall specify the quantity of water to be so taken and the price or rate to be paid for same :

And whereas it is also provided by section five of the said Act that if at least one-half of the total number of those owners or occupiers enter into contracts to take such quantity of water as the Governor-General thinks reasonable, at such a price or rate as the Governor-General may approve, an Order in Council authorizing the construction of the works may be issued :

And whereas the water-supply works mentioned in the First Schedule hereto are proposed to be constructed out of the funds provided by Parliament :

And whereas at least one-half of the total number of the owners or occupiers of the lands which are likely to be benefited thereby have entered into contracts with His Majesty to take water from such works when completed, which contracts specify the quantity of water to be supplied :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve and confirm the terms of the several contracts aforesaid, and doth hereby authorize the Minister of Public Works to construct, maintain, and control the water-supply works described in the First Schedule hereto.

FIRST SCHEDULE.

TARRAS irrigation works, for the irrigation of the Tarras District as described in the Second Schedule hereto, by means of water drawn from the Lindis River, and any dam or dams which are or may be constructed or acquired on that river or any other stream, such water being conveyed into the said district by the race known as R. K. Smith’s Race, or by any enlargement or extension thereof, or by any other race or races constructed or acquired by the Minister of Public Works in addition to or in lieu of the said R. K. Smith’s Race or any enlargement or extension thereof; the said works including all dams, weirs, reservoirs, tunnels, fluming, siphons, piping, measuring or regulating devices, and races, and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the said Tarras District.

SECOND SCHEDULE.

TARRAS IRRIGATION DISTRICT.

ALL that area in the Otago Land District bounded by a line commencing at a point in Run 236r, Tarras Survey District, on the left bank of the Clutha River, and proceeding thence along the line of the water-race in a south-easterly direction generally through the northernmost portion of the said Run 236r and Sections 6, 5, 7, 8, 17, 10, and 12 in Block XII, Tarras Survey District; Sections 5, 3, and 6 in Block XIV, Tarras Survey District; and the south-western portions of Sections 33 and 36 and the northernmost portion of Section 39; thence doubling towards the north generally through Section 38, the said Section 36 and Section 37, and through the north-eastern portions of the said Sections 36 and 33; thence to the east generally through Sections 32 and 31: thence towards the south through Sections 29 and 28 and the northernmost portion of Section 27; thence doubling towards the north again through the eastern portions of the said Sections 28 and 29; thence towards the east generally through Sections 30, 23, 24, 21, 20, 19, 16, 17, 2, and 1, all in Block I, Tarras Survey District, to the point of intersection of the said line of water-race with the Tarras–Cromwell Road; thence along the northern side of that road in a westerly direction to the southernmost corner of Section 27, Block I, Tarras Survey District; thence across that road and through the western portions of Run 236o, Section 2, Block XV, Tarras Survey District, and Runs 236p and 236q to the right bank of the Lindis River; thence along that bank, being the southern boundary of the said Run 236q and Run 236r, to its confluence with the Clutha River; thence proceeding in a northerly direction along the left bank of that river, being the western boundary of the said Run 236r and Runs 236s and 236t, to the point of commencement: and including the two separate areas (a) portion of Run 236m and (b) portions of Runs 236n and 236o: all as is delineated on the plan marked P.W.D. 56763, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
