Public Works Act Exemptions and Regulations




by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the New Plymouth Borough Council
on the fifth day of December, one thousand nine hundred and
twenty-one, viz. :—

“That the New Plymouth Borough Council, being the
local authority having control of the streets hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and seventeen, subsection
one, of the Public Works Act, 1908, shall not apply to
(a) that portion of the eastern side of Belt Road to which
Subdivisions 1, 2, and 3 of Section 9 and part Sections 8,
16, and 17 of Allotment A, Town Belt, New Plymouth,
have frontages ; (b) that portion of the southern side of
Hine Street to which Subdivisions 1 and 5 of Section 9
and part Sections 8, 16, and 17 of Allotment A, Town
Belt, New Plymouth, have frontages ";
subject to the condition that no building or part of a building
shall at any time he erected on the eastern side of the portion
of Belt Road and the southern side of the portion of Hine
Street described in the Schedule hereto within a distance of
thirty-three feet from the centre-line of the said portions of
streets.

SCHEDULE.

ALL that portion of street, situated in the Taranaki Land
District, Borough of New Plymouth, known as Belt Road,
abutting on Subdivisions 1, 2, and 3 of Section 9, and part
Sections 8, 16, and 17, of Allotment A, Town Belt, New
Plymouth.

Also all that portion of street, situated in the said land
district and borough, known as Hine Street, abutting on
Subdivisions 1 and 5 of Section 9 and part Sections 8, 16,
and 17 of Allotment A, Town Belt, New Plymouth.

As the said portions of streets are more particularly de-
lineated on the plan marked P.W.D. 53472, deposited in the
office of the Minister of Public Works at Wellington, in the
Wellington Land District, and thereon coloured green.

The North-western Side of Portion of Road in the Waimea
County exempted from the Provisions of Section 117 of the
Public Works Act, 1908, subject to a Condition as to the
Building-line.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1908, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Waimea County Council on the ninth day of
February, one thousand nine hundred and twenty-two, viz. :-

“That the Waimea County Council, being the local
authority having control of the road fronting Sections 30,
31, and 33, Block IX, Waimea Survey District, hereby
declares that the provisions of section one hundred and
seventeen of the Public Works Act, 1908, shall not apply
to the following portions of the north-eastern and north-
western sides of the said roads--commencing at the west
corner of Section 33, Block IX, Waimea Survey District ;
thence in a south-easterly direction for a distance of
994·8 links; thence in a south-easterly direction, com-
mencing at a point 2634·3 links from the said west corner
of Section 33, Block IX, Waimea Survey District, and
continuing for a distance of 1046·2 links; thence com-
mencing at the south-east corner of Section 31, Block IX,
Waimea Survey District, and continuing in a north-easterly
direction for a distance of 2094 links";
in so far as such resolution relates to the portion of road
described in the Schedule hereto, subject to the condition
that no building or part of a building shall at any time be
erected on the north-western side of the portion of road described in
the Schedule hereto within a distance of thirty-three feet from
the centre-line of the said portion of road.

SCHEDULE.

ALL that portion of road, situated in the Nelson Land District,
Waimea County, commencing at the south-eastern corner of
Section 31, Waimea South, Block IX, Waimea Survey Dis-
trict, and proceeding thence in a north-easterly direction for
a distance of 2094 links, abutting on the said Section 31 and
part Section 30, Waimea South, Block IX, Waimea Survey
District.

As the said portion of road is more particularly delineated
on the plan marked P.W.D. 51547, deposited in the office of
the Minister of Public Works at Wellington, in the Wellington
Land District, and thereon coloured red and marked E-F.

As the said portions of road are more particularly delineated
on the plan marked P.W.D. 51547, deposited in the office of
the Minister of Public Works at Wellington, in the Wellington
Land District, and thereon coloured red and marked A-B and
C-D respectively.

Revoking Shipping Regulations, 1917.

IN pursuance and exercise of the power and authority
conferred by section four of the War Regulations
Continuance Act, 1920, and of every other power and
authority enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby revoke the Shipping
Regulations, 1917, as set out in the part numbered fifteen of
the Second Schedule to the War Regulations Continuance
Act, 1920.
