the Governor-General, or the Governor-General in Council, under any Act, or otherwise howsoever, and in any arbitration held by the Audit Office between any two or more local authorities under the authority of any Act in that behalf, the costs and expenses of any such audit or arbitration shall be according to a scale which the Governor-General in Council is thereby authorized from time to time to fix and determine:

And whereas by an Order in Council issued on the twenty-third day of October, one thousand eight hundred and eighty-eight, certain fees were fixed under the authority of the Public Revenues Act, 1886, and it is expedient that the same should be altered:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section one hundred and twenty-two of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby fix and determine that, in all cases in which the accounts of any local authority are audited by the Audit Office under the provisions of the said Act or of any other Act in that behalf, or by order or appointment of the Governor-General, or the Governor-General in Council, under any Act, or otherwise howsoever, and in any arbitration held by the Audit Office between any two or more local authorities under the authority of any Act in that behalf, the costs and expenses of any such audit or arbitration shall be according to the following scale, instead of according to the scale set forth in the Order in Council of the twenty-third day of October aforesaid:—

  1. Arbitrations held by the Audit Office between two or more local authorities under the authority of any Act in that behalf,—

Where the time occupied in such arbitration does not exceed one day, ten pounds; for every day or part of a day in excess of one day, three pounds three shillings. And such charge shall be paid by each of the local authorities concerned, in such proportion as the Controller and Auditor-General directs.

  1. Special audits made by the Audit Office, by order or appointment of the Governor-General or Governor-General in Council, under any Act, or otherwise howsoever—

For every day, or part of a day in excess of one day, occupied in such audit, three pounds three shillings.

  1. Ordinary audits under the authority of the said Act or of any other Act in that behalf,—

For every day occupied in such audit, at the rate of three pounds three shillings a day, a day being reckoned at seven working-hours.

Validating Special Order altering Number of Members of Dunedin City Council, and validating Election of Councillors.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day of June, 1921.

Present:

THE HONOURABLE SIR F. H. D. BELL, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS the Dunedin City Council proceeded on the second day of March, one thousand nine hundred and twenty-one, by way of special order (hereinafter referred to as the “said special order”), under the provisions of section one hundred and forty-two of the Municipal Corporations Act, 1920 (hereinafter referred to as the “said Act”), to alter the total number of members of the said Council by reducing such number to twelve, exclusive of the Mayor, and provided that such alteration should take effect at and from the general election of Councillors held on the twenty-seventh day of April, one thousand nine hundred and twenty-one (hereinafter referred to as the “said election”):

And whereas the said special order was irregularly made under the provisions of section one hundred and forty-two of the said Act, in that such Act did not come into operation until the first day of April, one thousand nine hundred and twenty-one, and should properly have been made under the provisions of section one hundred and twenty-five of the Municipal Corporations Act, 1908:

And whereas the said election for the City of Dunedin was held in accordance with the provisions of the said special order, and it is desirable to validate the proceedings in connection therewith.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance of the powers vested in him by section three hundred and seventy-nine of the said Act, and of every other power and authority enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said special order and the said election shall be valid to all intents and purposes as if the said special order had been made under the provisions of section one hundred and twenty-five of the Municipal Corporations Act, 1908; and doth hereby further declare that the said proceedings shall not be called in question by reason only of the irregularity aforesaid.

Validating Irregularity in Election to fill Extraordinary Vacancy on Inglewood County Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day of June, 1921.

Present:

PRESIDING IN COUNCIL.

WHEREAS an extraordinary vacancy occurred in the Council of the Inglewood County on the fifth day of December, one thousand nine hundred and twenty:

And whereas the election to fill such extraordinary vacancy was omitted to be held within the period provided by section thirty-nine of the Local Elections and Polls Act, 1908, but was held on the second day of March, one thousand nine hundred and twenty-one, and it is expedient to validate the proceedings in connection therewith:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him in that behalf by section twenty-four of the Local Elections and Polls Amendment Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the proceedings in connection with the election held on the said second day of March, one thousand nine hundred and twenty-one, to fill the said vacancy shall be valid to all intents and purposes as if such election had been held within the period provided by the said section thirty-nine of the Local Elections and Polls Act, 1908; and doth further declare that the said proceedings shall not be called in question by reason only of the irregularity aforesaid.

WHEREAS the Mosgiel Borough Council proceeded on the fourth day of April, one thousand nine hundred and twenty-one, by way of special order (hereinafter referred to as the “said special order”), under the provisions of section one hundred and twenty-five of the Municipal Corporations Act, 1908, to alter the total number of members of the said Council by reducing such number to six, exclusive of the Mayor, and provided that such alteration should take effect at and from the general election of Councillors held on the twenty-seventh day of April, one thousand nine hundred and twenty-one (hereinafter referred to as the “said election”):

And whereas the said election for the Borough of Mosgiel was held in accordance with the provisions of the said special order, and it is desirable to validate the proceedings in connection therewith:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance of the powers vested in him by section three hundred and seventy-nine of the municipal Corporations Act, 1920, and of every other power and authority enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, notwithstanding anything contained in subsection one of section
