The Western Side of Portion of Adelaide Road, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of May, 1921.

Present:

THE HONOURABLE SIR F. H. D. BELL, K.C.M.G.,
PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the seventh day of April, one thousand nine hundred and twenty-one—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the western side of Adelaide Road beginning at a point forty-nine feet distant from the northern boundary of Town Acre 1015, and extending southward for a distance of forty-two feet, being whole frontage of Lot 2 in the City of Wellington”; subject to the condition that no building or part of a building shall at any time be erected on the western side of the portion of Adelaide Road described in the Schedule hereto within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of street situated in the Wellington Land District, City of Wellington, known as Adelaide road, abutting on Lot 2 of Section 1015. As the said portion of street is more particularly delineated on the plan marked P.W.D. 51220, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The Northern Side of Portion of Scarborough Terrace, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twentieth day of December, one thousand nine hundred and twenty—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of Scarborough Terrace beginning eighty feet from the eastern corner of Austin Street for a distance of eighty-three feet, being the whole frontage of Lot 10, Town Section 356, in the said city”; subject to the condition that no building or part of a building shall at any time be erected on the northern side of the portion of Scarborough Terrace described in the Schedule hereto within a distance of thirty-feet from the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of street situated in the Wellington Land District, City of Wellington, known as Scarborough Terrace, abutting on Lot 10, on Deeds plan No. 193, Town Section 356. As the said portion of street is more particularly delineated on the plan marked P.W.D. 50677, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The North-western Side of Portion of Aurora Terrace, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twenty-first day of April, one thousand nine hundred and twenty-one—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the north-western side of Aurora Terrace beginning at the south-eastern boundary of Town Section 500 and extending for a distance of 200 links, being the whole frontage of Town Section 500, and for a distance of 108·81 links, being part frontage of Town Section 498 in the City of Wellington”; such portion of street being described in the Schedule hereto.

SCHEDULE.

ALL that portion of street situated in the Wellington Land District, City of Wellington, known as Aurora Terrace, abutting on Town Section 500 and part Town Section 498. As the said portion of street is more particularly delineated on the plan marked P.W.D. 51500, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Validating Proceedings in connection with a Loan of £35,800 to be raised by the Manaia Town Board.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of May, 1921.

Present:

THE HONOURABLE SIR F. H. D. BELL, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS the Manaia Town Board, acting under and in pursuance of the Local Bodies’ Loans Act, 1913, lately proposed to raise a loan of thirty-five thousand eight hundred pounds for the purpose of constructing a sewerage scheme, waterworks, and water reticulation:

And whereas section ten of the said Act provides that the poll of ratepayers shall be taken not less than one nor more than three weeks after the day of the last publication of the notice of intention to raise the loan:

And whereas the poll of ratepayers was taken within one week after the day of the last publication of the notice of intention to raise the loan, inasmuch as the last publication of the said notice appeared in the issue of the Waimate Witness dated the twenty-seventh day of August, one thousand nine hundred and twenty, and the poll of ratepayers was held on the first day of September, one thousand nine hundred and twenty:

And whereas it appears that the ratepayers have not been misled by the said irregularity or defect, and it is expedient to validate same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken shall be valid to all intents and purposes as though the poll of ratepayers had been taken in the proper manner, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularity or defect aforesaid.
