Conferring on Mangawara River Board certain Powers of a Drainage Board.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is enacted by section twelve of the River Boards Amendment Act, 1913, that the Governor-General may, subject to such restrictions, modifications, and conditions as he thinks fit, from time to time by Order in Council confer upon any specified River Board such of the powers of a Drainage Board as he thinks fit: And whereas it is expedient to confer on the Mangawara River Board certain of the powers of a Drainage Board:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him in that behalf by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby confer upon the said Board all the powers exercisable by a duly constituted Drainage Board under section fourteen, sections seventeen to thirty (inclusive), and sections thirty-eight to forty (inclusive) of the Land Drainage Act, 1908, and section two of the Land Drainage Amendment Act, 1908, subject, however, to the following restrictions, modifications, and conditions, namely:—

1. None of the powers conferred by this Order in Council shall be exercisable by the Board in any part of the Mangawara River District comprised in any drainage district constituted under the said Land Drainage Act, 1908.

2. Section 14 shall only apply with respect to the powers conferred by this Order in Council.

3. All drainage-works to be constructed shall be paid for out of the proceeds of special loans secured by special rates over defined areas.

4. All special rates in respect of drainage-works shall be levied on a graduated scale according to a classification made by the Board of the rateable property within the area affected by the works.

5. Separate accounts shall be kept in respect of all drainage operations, and all moneys received in respect thereof shall be paid into a separate bank account.

6. Moneys payable as compensation in respect of land taken for drainage-works shall be paid out of the separate bank account.

7. Sections 38 to 40 shall only apply to the raising of special loans for the purpose of exercising any of the powers conferred by sections 17 to 30.

8. The powers conferred by this Order in Council shall be exercised subject to the provisions of section 88 of the Land Drainage Act, 1908.

Consenting to stopping Portions of Roads in Blocks X and XI, Waiau Survey District, Wairoa County.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section one hundred and thirty-three (a) of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped until the consent thereto of the Governor-General, by Order in Council gazetted, is obtained: And whereas the Wairoa County Council has applied for such consent in respect of the portions of roads described the Schedule hereto:

Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Wairoa County Council stopping the portions of roads described in the Schedule hereto.

Cook Islands.—Taking Land in the Island of Niue for Public Purposes.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-eighth day of June, 1920.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

I, ARTHUR WILLIAM DE BRITO SAVILE, Earl of Liverpool, Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance of the authority conferred upon me by section three hundred and fifty-seven of the Cook Islands Act, 1915, do hereby take the land described in the Schedule hereto, and situated in the Island of Niue, for a public purpose—to wit, as a site for a public hospital.

SCHEDULE.

ALL that parcel of land situate at Tufukia, near Alofi, Island of Niue, bounded on the south-east by the Alofi-Amanau Road, 132 ft.; on the south-west by Native land, 380 ft. (marked by a low stone wall); on the north-west by the sea at high-water mark, 132 ft.; and on the north-east by the Tufukia School block, 380 ft.

Domain Board appointed to have Control of the Nelson Creek Domain.

WHEREAS by section forty of the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor-General may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to Part II of the said Act, control of such domain:

And whereas by an Order in Council made on the twenty-third day of July, one thousand nine hundred and six, and published in the New Zealand Gazette of the twenty-sixth day of that month, a Domain Board was appointed to control the Nelson Creek Domain:

And whereas the appointment of the said Board was revoked:

And whereas it appears expedient to again appoint a Domain Board to control the domain:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint
