Declaring Portion of Paraheka Road, in the Waitomo County, to be a County Road.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of Paraheka Road, in the Taranaki Land District, Waitomo County, commencing at its junction with the Kumara Road, and proceeding thence generally in a westerly direction, adjoining or passing through Sections 14 and 22, Block I, Aria Survey District, and terminating at the boundary of Waitomo and Ohura Counties; being a distance of twenty-five chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 48637, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red and marked A-B.

Portion of Princes Street, Onehunga, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or to any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose:

And whereas the Onehunga Borough Council, being the local authority having control of the portion of street described in the Schedule hereto, has passed the following resolution—viz., “The Onehunga Borough Council, being the local authority having control of that portion of Princes Street between Queen Street and Victoria Street, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said portion of street”:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that portion of Princes Street, in the Borough of Onehunga, situated between Queen Street and Victoria Street in the said borough. As the said portion of street is more particularly delineated on the plan marked P.W.D. 48023, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Partial Revocation of an Order in Council prohibiting all Alienation of certain Native Land other than Alienation in favour of the Crown.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section three hundred and sixty-three of the Native Land Act, 1909, it is enacted that any Order in Council made under that section may at any time be varied or revoked:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council referred to in Part I of the Schedule hereto, but only in so far as it affects the land mentioned in Part II of the said Schedule.

SCHEDULE.

PART I.

ORDER in Council under section 363 of the Native Land Act, 1909, dated the 26th day of January, 1920, and gazetted the 13th day of February, 1920, affecting Kohatutaka No. 1 and other subdivisions.

PART II.

Kohatutaka No. 6k No. 1 Block, containing 821 acres 2 roods 28 perches, more or less, situate in Punakitere and Waoku Survey Districts.

Consenting to Land being taken for the More Effective Carrying-out of Drainage or other Works in the Hauraki Plains.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the Public Works Act, 1908, it is, in section fifteen thereof, inter alia, enacted that, except for the purpose of a railway or defence purposes, or for the purposes of any other work to be made under the authority of a special Act, nothing in this Act contained shall authorize the taking of any land occupied by any building, yard, garden, orchard, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor-General in Council:

And whereas part of the land described in the Schedule hereto is occupied by buildings, and the Minister of Public Works has recommended the Governor-General to issue an Order in Council under the said Act consenting to the taking of the said land for the more effective carrying-out of drainage or other works in the Hauraki Plains:

Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes above mentioned.

SCHEDULE.

APPROXIMATE area of the piece of land being taken: 4 acres 2 roods.

Being Ongarehu or Te-Kata-a-te-Kawau Block, situated in Block VI, Waihou Survey District (Auckland R.D.). (S.O. 20644.)

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 47362, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon edged red.
