Public Works Act Exemptions




SULBY Road, Cashmere Hills, in the Heathcote County, exempted
from the Provisions of Section 117 of the Public Works
Act, 1908.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this nineteenth
day of January, 1920.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.
WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908,
it is, inter alia, provided that the said section shall not
apply in any case where the local authority having control of
any road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor-General in Council;
And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is provided
that such approval may be either absolute or subject to such
conditions with respect to the building-line as the Governor-
General by Order in Council thinks fit to impose :
And whereas the Heathcote County Council, being the local
authority having control of the road described in the Schedule
hereto, has passed the following resolution—viz., “That the
Heathcote County Council hereby resolves that the provisions
of section one hundred and seventeen of the Public Works
Act, 1908, shall not apply to the road specified in the Schedule
hereto, the width of such road being nowhere less than 40 ft.
Schedule.
“All that road situated in the Cashmere Riding of the
County of Heathcote, being the road intersecting the land
off Cracroft Terrace, containing 1 rood 32·7 perches, and
being parts of Lots 2, 3, 4, 5, 6, and the whole of Lot 7 on
D.P. No. 3858, as shown on plan annexed hereto”:
And whereas it is deemed expedient that such resolution
should be approved:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution.
SCHEDULE.
All that portion of road situated in the Canterbury Land
District, Heathcote County, known as Sulby Road, Cashmere
Hills, commencing at its junction with Cracroft Terrace, and
proceeding thence generally in a southerly direction and termi-
nating at the south-western boundary of Lot 6, D.P. 3858.
As the said portion of road is more particularly delineated
on the plan marked P.W.D. 47249, deposited in the office of
the Minister of Public Works at Wellington, in the Wellington
Land District, and thereon coloured red.

The North-eastern Side of Portion of Bridge Street in the
Borough of Lower Hutt exempted from the Provisions of
Section 117 of the Public Works Act, 1908, subject to a
Condition as to the Building-line.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it is,
inter alia, provided that the said section shall not apply in
any case where the local authority having control of a
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or any
specified part thereof, and such resolution is approved by

subsection one of section thirteen of the Public Works
Amendment Act, 1911, it is provided that such approval may
be either absolute or subject to such conditions with respect
to the building-line as the Governor-General by Order in
Council thinks fit to impose, and may refer to one or both
sides of the road or street:
And whereas the Lower Hutt Borough Council, the local
authority having control of the portion of street described
in the Schedule hereto (hereinafter referred to as "the said
portion of street"), has passed the following resolution—viz.,
"Whereas the owners of part of Section 24, Hutt District,
containing 2 roods 21·8 perches, and being the whole of the
land comprised in certificate of title, Vol. 115, folio 101, are
subdividing the said land into allotments for the purpose of
sale within the meaning of section one hundred and seven-
teen of the Public Works Act, 1908 : And whereas the said
land fronts Bridge Street, Lower Hutt, a street of less than
66 ft. in width: Now, the Lower Hutt Borough Council does
hereby resolve that the provisions of the said section one
hundred and seventeen of the said Act, relating to the setting-
back of the frontage of the land to a distance of 33 ft. from
the centre-line of the road or street, shall not apply to so
much of Bridge Street as fronts the said property; subject,
however, to the Governor-General in Council imposing a
condition that no building shall be erected on the said land or
any part thereof within a distance of 33 ft. from the centre-
line of the said street":
And whereas it is deemed expedient that such resolution
should be approved in so far as it refers to the north-eastern
side of the said portion of street, subject to the condition
hereinafter mentioned:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise
of the powers conferred by the above-in-part-recited Acts,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby approve of
the said resolution to the extent hereinbefore mentioned,
subject to the condition that no building, or part of a building,
shall be erected at any time on the north-eastern side of the
said portion of street, within a distance of thirty-three feet
of the centre-line of the said portion of street.
SCHEDULE.
THE north-eastern side of portion of Bridge Street, situated
in the Wellington Land District, Borough of Lower Hutt,
abutting on part Section 24, Hutt District. As the said
portion of street is more particularly delineated on the plan
marked P.W.D. 47598, deposited in the office of the Minister
of Public Works at Wellington, in the Wellington Land Dis-
trict, and thereon coloured red.

The Eastern Side of Exeter Street, St. Albans, in the City of
Christchurch, exempted from the Provisions of Section 117
of the Public Works Act, 1908.

resolution declares that the provisions of section one hundred
and seventeen of the Public Works Act, 1908, shall not apply
to the eastern side of the said street":
