  1. Application by the widow of a deceased member of the Forces for an increased pension under section 10 of the Amendment Act, 1917, shall be made in the form provided for the purpose, and shall be lodged with the nearest Registrar of Pensions, who shall forward it to the Commissioner of Pensions for submission to the War Pensions Board.

  2. (1.) Application by a member of the Imperial Forces in receipt of an Imperial pension, or by any dependant of any such member, for a pension under section 14 of the Amendment Act, 1917, shall be made in the form provided for the purpose, and shall be lodged with the nearest Registrar of Pensions, who shall forward it to the Commissioner of Pensions for submission to the War Pensions Board.

(2.) Every such application shall be accompanied by a certificate from the Ministry of Pensions in London that the maximum pension payable under the Royal Warrant gazetted on 29th March, 1917, or under any warrant subsequently issued and for the time being in force, has been made available to the applicant.

MEDICAL TREATMENT.

  1. (1.) Where a partially disabled member of the Forces in receipt of a pension is undergoing medical or curative treatment with the authority of the Director-General of Medical Services as an in-patient of, or as an out-patient at, any hospital or other institution, or is undergoing such treatment in accordance with any scheme approved by the War Pensions Board, being thereby precluded from following any occupation, application for an increased pension under subsection (1) of section 7 of the Amendment Act, 1917, may be made by the said member or by any of his dependants, and may be made to any Registrar of Pensions or direct to the Commissioner of Pensions, and every such application shall in due course be submitted to the War Pensions Board for decision.

(2.) Every application under the foregoing provisions of this regulation, in respect of treatment that is not being provided with the authority of the Director-General of Medical Services, shall be accompanied by a medical certificate indicating the nature of the disability for which treatment is being given, the nature and probable duration of such treatment, and the extent to which the member’s earning-capacity is affected.

  1. (1.) Where a partially disabled member of the Forces undergoing medical or curative treatment as aforesaid is in regular employment, and for the purposes of such treatment has to absent himself from work, he may make application to any Registrar of Pensions, or direct to the Commissioner of Pensions, for an allowance under subsection (2) of section 7 of the Amendment Act, 1917, to cover any loss of wages or out-of-pocket expenses incurred in connection with the said treatment.

(2.) Every such application shall, in the case of a claim for loss of wages, be accompanied by a certificate from the employer of the said member, and, in the case of a claim for incidental expenses, by receipts where obtainable for such expenses.

  1. Where a disabled member of the Forces who has applied for and been granted a pension is, on the advice of a Medical Board, recommended to undergo or continue medical or curative treatment, and such advice is not accepted, and the Director-General of Medical Services certifies that such treatment is available without expense to the member, and that the refusal to accept the same is unreasonable, the Commissioner of Pensions shall, after notifying the said member, where necessary, of the provisions for increased pensions under section 7 of the Amendment Act, 1917, call upon him to show cause why the treatment offered should not be accepted, and in the event of the refusal being persisted in the War Pensions Board shall determine what portion, if any, of the pension payable in respect of the disablement shall be withheld pursuant to the provisions in that behalf of section 6 of the last-mentioned Act.

  2. If, after treatment has been accepted, the disabled member of the Forces in receipt of a pension refuses to carry out the treatment prescribed, or acts in such a manner as to retard his recovery, the Commissioner of Pensions shall forthwith stop payment of the pension pending the decision of the War Pensions Board.

  3. Where a disabled member of the Forces in receipt of a pension is, under authority from the Director-General of Medical Services, an inmate of a hospital or other institution, the maximum amount that shall be paid to him by way of pension either directly or by arrangement with the authorities of the institution shall be 10s. a week, and any balance shall be retained and paid to him on his discharge from the institution, or paid, at the discretion of the War Pensions Board, to the wife or such other dependant as may be determined.

PAYMENT OF PENSIONS.

  1. Clause 12 of the regulations under the War Pensions Act, 1915, dated the 23rd day of August, 1915, and published in the Gazette of the 26th day of the same month, is hereby revoked, and the following regulation is substituted therefor:—
    “12. Every pension granted shall be payable by equal monthly instalments, of which the first shall be payable on the first day of the month next after the commencement of the pension-year; provided that any such instalment may be paid not earlier than the 23rd day of the month preceding the due date of payment.”

Consenting to stopping Portion of a Road in Blocks I and IX, Gimmerburn District, Maniototo County.

WHEREAS by section one hundred and thirty-three (a) of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped until the consent thereto of the Governor-General, by Order in Council gazetted, is obtained:

And whereas the Maniototo County Council has applied for such consent in respect of the road described in the Schedule hereto:

Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Maniototo County Council stopping the road described in the Schedule hereto.

SCHEDULE.

Approximate area of the piece of road permitted to be stopped: 1 acre 3 roods 8 perches.

Adjoining or passing through Sections 11 and 1, Blocks I and IX, Gimmerburn District.

In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 42191, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.
