Warrant authorizing the Waikato County Council to construct a Bridge over the Waikato River at Horotiu, and apportioning the Cost.
LIVERPOOL, Governor-General.
WHEREAS by section one hundred and nineteen of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is, inter alia, enacted that in any case where the local authority of any district desires to construct a bridge, or to establish a ferry or ford, in any position that will, in its opinion, be of advantage or benefit to the whole or any considerable portion of the inhabitants of an adjacent district as well as to the inhabitants of its own district, and where it is, in the opinion of such local authority, reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing the said bridge, ferry, or ford, the provisions of the said section shall have effect:
And whereas the Waikato County Council has given notice and taken the steps required by the said Act, and has made application to the Governor-General to authorize the construction of the bridge and approaches mentioned in the Schedule hereto, and hereinafter referred to as “the said work,” and to apportion the cost of constructing and establishing the said work between the said Council and the Waipa County Council:
And whereas it has been agreed by and between the Waikato County Council and the Waipa County Council that the Waipa County Council shall pay one-third and the Waikato County Council shall pay two-thirds of the cost of the said work:
And whereas no objection has been made by the other local authority which it is proposed should contribute to the cost of the said work:
And whereas I am of opinion that the said work should be done, and that it is expedient to make provision under the said Act for the purpose and in the manner hereinafter set forth:
Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the said Act, and all other powers and authorities in anywise enabling me in this behalf, do hereby authorize the Waikato County Council to execute the said work, and I do hereby declare that the cost thereof shall be borne by the Waikato County Council and the Waipa County Council in accordance with the aforesaid agreement; and I do hereby further direct that any contribution hereby required to be made as aforesaid by the Waipa County Council shall be paid from time to time, in the proportion hereinbefore prescribed, out of the funds of the said Council, within a period of one month after demand in writing made by or on behalf of the Waikato County Council, and all such payments shall be made from time to time to the Clerk of the Waikato County Council for and on behalf of the Waipa County Council.
SCHEDULE.
THAT bridge over the Waikato River at Horotiu, between Allotment 79, Komakorau Parish, and Allotment 103, Horotiu Parish, Block XII, Newcastle Survey District, including the approaches thereto, the eastern approach commencing at a point distant 210 ft. from the said bridge in the said Allotment 79, and the western approach commencing at a point distant 150 ft. from the said bridge in the said Allotment 103. As the site of the said bridge and approaches is more particularly delineated on the plan marked P.W.D. 43499, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District.
