  1. “Detention-barrack” means any building or place in the possession of the Crown (not being a prison or police gaol under the Prisons Act, 1908) declared by the Minister of Defence, by warrant gazetted, to be a detention-barrack for the purposes of the Army Act.

  2. The control and administration of detention-barracks shall be in accordance with military orders, and in default of such orders, or so far as they do not extend, then in accordance with the discretion of the officer in command of the barrack.

  3. Every person sentenced to imprisonment by a Court-martial in New Zealand shall be detained either in a prison or police gaol under the Prisons Act, 1908, or in some other place appointed for that purpose under the authority of section 19 of the Defence Amendment Act, 1912, as may be determined from time to time by a committing authority under these regulations.

  4. (1.) “Committing authority” in respect of every person sentenced to imprisonment or detention by a Court-martial means and includes any of the following persons:—
    (a.) The officer by whom the sentence of the Court-martial has been confirmed;
    (b.) The Commanding Officer of the person so sentenced;
    (c.) An authorized officer under the Military Service Act, 1916;
    (d.) An Officer Commanding a Military District.

(2.) “Committing authority,” in respect of every person sentenced to detention by a Commanding Officer, means and includes the following persons:—
(a.) The Commanding Officer of the person so sentenced.
(b.) An authorized officer under the Military Service Act, 1916.
(c.) An Officer Commanding a Military District.

  1. A committing authority may from time to time order the removal of any person so sentenced to imprisonment or detention from one lawful place of confinement to another, or may transfer to a detention-barrack any person sentenced to detention and committed to military custody, or may transfer to military custody any person committed to a detention-barrack.

  2. The military custody of persons pending their trial for offences against the Army Act, or pending their reception to a prison, detention-barrack, or other lawful place of confinement in execution of any sentence of imprisonment or detention, and the military custody of persons committed to such custody in execution of any sentence of detention, shall be in accordance with military orders, and in default of such orders, or so far as they do not extend, shall be in accordance with the discretion of Commanding Officers.

  3. These regulations shall, so far as applicable, extend and apply to persons sentenced to imprisonment or detention before the making of these regulations.

The regulations made under the Defence Act, 1909, on the 22nd day of December, 1913, are hereby amended by revoking clause 236 thereof relating to the execution of sentences of imprisonment and detention.
