SCHEDULE.

ALL that portion of Moxham Avenue situated in the Wellington Land District, City of Wellington, abutting on portion of Lot 44A, D.P. 65.

Also all that portion of Goa Street in the said Land District and City situated between Moxham Avenue and Hamilton Road.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 44925, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Palmer Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this eighteenth day of November, 1918.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General, by Order in Council, thinks fit to impose:

And whereas the Wellington City Council, being the local authority having control of the street described in the Schedule hereto, has passed the following resolution—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Palmer Street in the said city”:

“The Council further resolved that section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the portion of Willis Street lying between Palmer Street and Aro Street, nor to the portion of Aro Street to which Town Acres 46 and 48 have a frontage; subject, however, to the building-line being set back thirty-three feet from the centre-line of the streets as far as concerns the portions of streets above defined”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to Palmer Street:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it refers to Palmer Street.


SCHEDULE.

ALL that street in the Wellington Land District, City of Wellington, known as Palmer Street, adjoining or passing through Town Acres 48, 46, 44, and 42. As the said street is more particularly delineated on the plan marked P.W.D. 44895, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Road in Block IV, Waimea Survey District, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas the Stoke Road Board, being the local authority having control of the said road described in the Schedule hereto, has passed the following resolution—viz., “The Stoke Road Board, being the local authority having control of the road coloured pink shown in the plan (P.W.D. 44850) submitted by Mr. Ledger, Surveyor, hereby declares by resolution that section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the road shown on the said plan between the points marked ‘A’ and ‘B’ and coloured pink”:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.


SCHEDULE.

ALL that road situated in the Nelson Land District, Waimea County, Stoke Road District, commencing at its junction with Parkers Road, and proceeding thence generally in a north-easterly direction, adjoining or passing through Sections 25, 26, 27, part 42 and 29, Block IV, Waimea Survey District, and terminating at its junction with a public road at the north-eastern corner of the said Section 29. As the said road is more particularly delineated on the plan marked P.W.D. 44850, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured pink.

The South-western side of Portion of Pacific Street, Township of Nevada, City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-fifth day of November, 1918.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Dunedin City Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That the Council of the City of Dunedin hereby resolves that section 117 of the Public Works Act, 1908, shall not apply to that portion of the public street in the City of Dunedin known as Pacific Street which abuts on parts of Sections 14, 15, and 16, Township of Nevada, as the same is more particularly shown by red colour on the plan annexed hereto”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the south-western side of the said portion of street, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the
