SCHEDULE.

ALL that area in the Canterbury Land District, containing by admeasurement 1 rood, more or less, being part of Rural Section 85, Block X, Christchurch Survey District, bounded as follows: Commencing at a point on the eastern side of the road which forms the western boundary of said Rural Section 85, distant 900 links from the Riccarton Road; thence towards the north-east and south by the other part of the said Rural Section 85, 250, 100, and 250 links respectively; and towards the west by the aforesaid public road, 100 links. As the same is more particularly delineated on the plan marked L. and S. 6/1/208, deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon coloured green.

Vesting the Control of a Reserve in the Cape Kidnapper Bird Sanctuary Board.

ORDER IN COUNCIL.

At the Government House at Wellington, this tenth day of September, 1918.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section two of the Public Reserves and Domains Amendment Act, 1914, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby extend the period for which the control of the reserve described in the Schedule hereto (being a reserve for the protection of gannets) was vested in the Cape Kidnapper Bird Sanctuary Board, as constituted by an Order in Council dated the eleventh day of September, one thousand nine hundred and fifteen, and published in the Gazette of the sixteenth day of that month, for three years from the eleventh day of September, one thousand nine hundred and eighteen, to the eleventh day of September, one thousand nine hundred and twenty-one; and doth hereby declare that the provisions of the said Order in Council shall continue in force for the said extended period.


SCHEDULE.

ALL that area in the Hawke’s Bay Land District, containing by admeasurement 31 acres 2 roods, more or less, being Section 1, Block III, Kidnapper Survey District. Bounded towards the north generally by Hawke Bay; towards the south-east generally by the South Pacific Ocean; towards the south generally by part Block 7, Kidnapper Crown-grant District, 5743·94 links; and towards the north-west by said part Block 7, 168·9 links.

Also two areas containing by admeasurement 1 rood 24 perches and 16 perches, more or less, respectively, being islands situated off Cape Kidnapper.

Be all the aforesaid linkages more or less. As the same are delineated on the plan marked L. and S. 126/25, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

The Southern Side of Portion of Rattray Street, in the Borough of Devonport, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this tenth day of September, 1918.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor-General by Order in Council thinks fit to impose and may refer to one or both sides of the road or street:

And whereas the Devonport Borough Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as “the said portion of street,” has passed the following resolution—viz., “That Buchanan Street and Rattray Street, abutting on the property of the late Mr. William Philcox, be exempted from the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the southern side of the said portion of street, subject to the condition herein-after mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building or part of a building shall at any time be erected on the southern side of the said portion of street within a distance of thirty feet of the centre-line of the said portion of street.


SCHEDULE.

ALL that portion of the southern side of Rattray Street, in the Auckland Land District, Borough of Devonport, adjoining portion of Allotment 20A of Section 2, Takapuna Parish. As the said portion of street is more particularly delineated on the plan marked P.W.D. 44195, deposited in the office of the Minister of Public Works at Wellington, in the Land District of Wellington, and thereon coloured yellow.

Notifying the Proposed Exchange of Crown Land in the Hawke’s Bay Land District for other Land.

LIVERPOOL, Governor-General.

WHEREAS by section one hundred and forty-two of the Land Act, 1908, as amended by section seventeen of the Land Laws Amendment Act, 1913, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1908, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive by way of equality of exchange any sum not exceeding twenty-five per centum of the estimated value of the Crown land so granted:

And whereas, in the opinion of the Governor-General, it is expedient to exchange the Crown land described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare that it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.


SCHEDULE.

DESCRIPTION OF CROWN LAND AUTHORIZED TO BE EXCHANGED.

ALL that area in the Hawke’s Bay Land District, containing by admeasurement 23 acres 3 roods 36 perches, more or less, being part of Subdivision 5, Whareraurakau Block, Block XXII, Waiau Survey District. As the same is delineated on the plan marked L. and S. 22/160, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.


SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

ALL that area in the Hawke’s Bay Land District, containing by admeasurement 14 acres 0 roods 35 perches, more or less, being part of Subdivision A 12B, Putere Block, Block XVIII, Waiau Survey District. As the same is delineated on the plan
