Hayes Street, Brooklyn, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-second day of December, 1917.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose:
And whereas the Wellington City Council, being the local authority having control of the street described in the Schedule hereto, has passed the following resolution—viz., “The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Hayes Street in the said city . . .”;
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
All that street in the Wellington Land District, City of Wellington, known as Hayes Street, situated between Ohiro Road and Adams Street, Brooklyn.
As the said street is more particularly delineated on the plan marked P.W.D. 42689, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

WHEREAS by section two of the Public Works Amendment Act, 1911, it is provided that no person shall lay, construct, place, put up, or use any electric line except under the authority of a license issued by the Governor-General in Council under that Act:
And whereas Joseph Cobine and Hugh Graham Cecil Ernest, of Papatoetoe, motor-garage proprietors (hereinafter referred to as “the licensees”), desire to erect electric lines along the route defined in the Schedule hereto, and hereinafter called “the said route,” and it is expedient accordingly to issue a license in respect thereof under the said section:
Now, therefore, in pursuance and exercise of the powers conferred upon him by the said section, and of all other powers in anyway enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the conditions set forth in the Schedule hereto, and to the regulations made under section two of the aforesaid Act and published in the New Zealand Gazette dated the twenty-ninth day of April, one thousand nine hundred and fifteen, and hereinafter referred to as “the regulations,” hereby authorize the licensees to erect and maintain electric lines along the said route for lighting, power, and heating purposes.
SCHEDULE.
- THE ROUTE OF THE ELECTRIC LINES AUTHORIZED.
THAT route across Station Road leading to the Papatoetoe Railway-station between the garage of Messrs. Joseph Cobine and Hugh Graham Cecil Ernest and the Public Hall, near the Rangitoto Road corner. As the said route is more particularly delineated on the plan marked P.W.D. 43061, deposited in the office of the Minister of Public Works, Wellington, in the Provincial District of Wellington, and thereon shown by a broken red line. - SYSTEM OF SUPPLY.
The system of supply shall be as described in paragraph l (a) of clause 2 of the regulations.
The generating voltage shall be approximately 100 to 110 volts between the terminals. - DATUM TEMPERATURE.
For the purpose of calculating the stresses as provided in clause 12 of the regulations, the datum temperature shall be taken as 20 degrees Fahrenheit. - CHARGES FOR ELECTRIC ENERGY.
The charge for electrical energy shall not exceed ls. per unit for lighting purposes, and 6d. per unit for motor-power, heating, or cooking purposes; provided that “lighting purposes” shall include the operation of motor generators for lighting purposes. - DURATION OF LICENSE.
The license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of forty-two years from the date hereof. Upon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon cease and determine; but such expiration or determination shall not relieve the licensee of any liability theretofore incurred under this license.

And whereas the New Plymouth Borough Council, the local authority having control of the portions of streets, described in the Schedule hereto, has passed the following resolution—viz., “That the New Plymouth Borough Council, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to those parts of Downe Street, Dawson Street, and Harris Street, New Plymouth, to which Sections 803 to 808, New Plymouth (both inclusive) have frontages”;
And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the portions of the southern side of Downe Street and the eastern side of Dawson Street described in the Schedule hereto:
