Land taken for a Further Portion of the East Coast Main Trunk Railway (Otamarakau Section).

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is required to be taken for a further portion of the East Coast Main Trunk Railway (Otamarakau Section):

And whereas all the conditions precedent required by law to be observed and performed prior to the taking of such land for the purposes hereinbefore specified have been observed and performed:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section one hundred and eighty-eight of the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is hereby taken for a further portion of the said line of railway hereinbefore specified.

APPROXIMATE areas of the pieces of land taken:—

A. R. P. Portion of Pukehina Block
9 3 33 Section M. 4B; coloured red (sheet 8).
3 1 19 „ coloured red (sheet 9).
4 3 31 „ coloured sepia (sheet 9).

Situated in Block III, Waihi South Survey District. (S.O. 18770.)

In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 39532, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.

Revoking Part of a Proclamation taking Land for a Further Portion of the East Coast Main Trunk Railway (Pongakawa and Otamarakau Sections), and for Road-diversions in connection therewith.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation or the making or gazetting thereof, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation, either wholly or so far as he thinks necessary:

And whereas it is found that part of the land taken for a further portion of the East Coast Main Trunk Railway (Pongakawa and Otamarakau Sections), and for road-diversions in connection therewith, by a Proclamation made under the Public Works Act, 1908, dated the twentieth day of December, one thousand nine hundred and sixteen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 4, pages 13 and 14, of the eleventh day of the following month, is incorrectly described:

And whereas compensation in respect of the taking of the said land has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects the land described in the Schedule hereto.

Ashburton County War Relief Fund Society incorporated under the War Funds Act, 1915.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this fourteenth day of May, 1917.

Present:

THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

WHEREAS by section twelve of the War Funds Act, 1915 (hereinafter referred to as “the said Act”), it is provided that the Governor may, by Order in Council gazetted, incorporate a society possessing a war fund, or the trustees of such fund: And whereas application, in writing addressed to the Minister, has been made by the Ashburton County War Relief Fund Society (being a society possessing a war fund), praying for the incorporation of that society:

And whereas it is considered desirable to grant such application:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the society known as the Ashburton County War Relief Fund Society is hereby incorporated for the purposes of the said Act as from the publication hereof in the New Zealand Gazette, and shall be known as the Ashburton County War Relief Fund Society.
