Oaonui Irrigation District, County of Egmont constituted under the Land Drainage Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this twelfth day of November, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, in accordance with the provisions of the fifty-ninth section of the Land Drainage Act, 1908, a majority of the ratepayers in the area described in the Schedule hereto, situated in the County of Egmont and Oaonui Settlement, have presented a petition to His Excellency the Governor-General of the Dominion of New Zealand, praying that the land comprised in the said area be declared to be a district under Part II of the said Act: And whereas the provisions of the Water-supply Act, 1908, cannot conveniently be adopted in the said area:

Now, therefore, in pursuance and exercise of the power and authority contained in the said fifty-ninth section of the Land Drainage Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district under Part II of the said Act for the purpose of the maintenance and construction therein of water-races for the supply of water for irrigation of land, and otherwise for the use and convenience of the public in any manner other than for domestic use; and, with the like advice and consent as aforesaid, His said Excellency doth hereby declare that the said district shall be called by the name of “The Oaonui Irrigation District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees of the said district shall consist of five members to be elected under and in accordance with the said Act; and also that this Order shall come into effect on and after the first day of December, one thousand nine hundred and seventeen.


SCHEDULE.

ALL that area in the Taranaki Land District bounded by a line commencing at the mouth of the Koteoteo Stream, thence along the seashore to the western boundary of Section 6, Block XV, Opunake Survey District, and along the western boundary of that section to its north-western corner; along the northern boundary of that section and of Section 5 to its north-eastern corner; thence along a right line to the intersection of the eastern side of South Road with the northern side of Hitona Road; along the northern side of that road to the southernmost corner of Section 21, Subdivision 3, Ngatitara Block; along the south-eastern and north-eastern boundaries of that subdivision to and across the Oaonui Stream; along the right bank of that stream to Subdivision 30, Ngatitara Block; thence along the south-western, north-western, and north-eastern boundaries of that subdivision to Arawhata Road, across that road, and along its south-eastern side to Subdivision 16, Ngatikahumate Block; along the north-eastern and south-eastern boundaries of that subdivision and the south-eastern boundaries of Subdivisions 14, 12, 10, 8, and part of the south-western boundary of the said Subdivision 8; along the south-eastern boundaries of Subdivisions 6 and 4 and the south-western boundary of Subdivision 5, Ngatikahumate Block, to and across Opua Road; along the south-eastern side of that road to and along the eastern side of South Road to and across the Koteoteo Stream, and along the left bank of that stream to the sea, the place of commencement.

Directing the Sale of Land under the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this twelfth day of November, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever for any public work, is not required for such public work, the Governor-General may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas a memorial has been laid before the Governor-General by the Palmerston Borough Council (hereinafter called “the said Council”), accompanied by a map, setting forth that certain land was acquired for the purpose of erecting a Coronation Hall thereon:

And whereas the said hall has been erected, and the said land described in the Schedule hereto is not now required by the said Council for the purposes aforesaid, and the said Council desires to sell the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto.


SCHEDULE.

APPROXIMATE area of the piece of land: 6·07 perches.
Portion of Section 8, Block XXVIII, Borough of Palmerston.

In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 43108, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.

Declaring Portion of Wairata Track Road, in the Opotiki County, to be a County Road.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-ninth day of October, 1917.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.


SCHEDULE.

ALL that portion of the Wairata Track Road, in the Auckland Land District, Opotiki County, commencing at a bridge over the Waioeka River known as McCauley’s Bridge, a point on the eastern boundary of Section 8, Block XV, Waioeka Survey District, and extending thence generally in a south-westerly direction, adjoining said Section 8 and Section 1, Block III, Waioeka Survey District, to the junction of the Wairata Stream with the Waioeka River; thence generally in a westerly direction, adjoining said Section 1 and Section 3, Block III, Waioeka South Survey District, and part Section 9, Block XV, Waioeka Survey District, to a point on the southern boundary of said Section 9; being a distance of four miles, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 43159, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
