Declaring Portion of Bayley’s Track Road, in the Opotiki County, to be a County Road.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.

At the Government House at Wellington, this fifth day of November, 1917.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of Bayley’s Track, known as “Access to Section 7, Block XV, Waioeka Survey District,” in the Auckland Land District, Opotiki County, commencing at a bridge over the Waioeka River known as McCauley’s Bridge, a point on the eastern boundary of Section 8, Block XV, Waioeka Survey District, and extending thence generally in a northerly direction, adjoining said Section 8 and part Section 7, Block XV, Waioeka Survey District, and terminating at a point on the eastern boundary of said Section 7; being a distance of 1 mile 25 chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 43160, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Declaring Road in Block I, Takahue Survey District, to be a Government Road.

At the Government House at Wellington, this twelfth day of November, 1917.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, become a Government road.

SCHEDULE.

APPROXIMATE area of road declared a Government road: 2 acres 2 roods.

Adjoining or passing through Lot 1 of Allotment 23, Parish of Awanui, Block I, Takahue Survey District. (S.O. 19812.)

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 43227, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.

Declaring Portions of Roads in Block I, Waimea Survey District, to be Government Roads.

At the Government House at Wellington, this twelfth day of November, 1917.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of roads described in the Schedule hereto shall, on and after the date of this Order in Council, become Government roads.

Portion of the Eastern Side of Tory Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this fifth day of November, 1917.

Present:

His Excellency the Governor-General in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Wellington City Council, the local authority having control of the portion of street, described in the Schedule hereto, hereinafter referred to as the said portion of street, did, on the eighteenth day of October, one thousand nine hundred and seventeen, pass the following resolution—viz., “The Wellington City Council, being the local authority having control of the street in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the eastern side of Tory Street lying between Wakefield Street and Courtenay Place”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the eastern side of the said portion of street:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned.

SCHEDULE.

ALL that portion of Tory Street, situated in the Wellington Land District, City of Wellington, lying between Courtenay Place and Wakefield Street. As the said portion of street is more particularly delineated on the plan marked P.W.D. 43049, deposited in the office of the Minister of Public Works at Wellington, in the Provincial District of Wellington, and thereon coloured red.
