exhibit therefrom and maintain at its own cost suitable and necessary lights for the guidance of vessels; provided that no light shall be exhibited until after it has been approved by the Minister.

Any person authorized by the Minister may at all reasonable times enter upon the said wharf and shed and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the company in New Zealand a notice in writing of any defect or want of repair in such wharf and shed, requiring it, within a reasonable time, to be therein prescribed, to repair the same, it shall with all convenient speed cause such defect to be removed or such repairs to be made.

Nothing herein contained shall authorize the company to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Minister of Customs, or with any provisions of the Harbours Act, 1908, or its amendments, or any regulations made thereunder, and that are now or may hereafter be in force.

The ballast of all vessels loading at the said wharf shall be taken away by the company and deposited above high-water mark, or at such place as may be approved of by the Minister, or by any person appointed by the Minister for that purpose.

The rights, powers, and privileges conferred by or under this Order in Council shall continue in force for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the company shall not assign, charge, or part with any such right, power, or privilege without the written consent of the Minister first obtained.

The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the company three calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister and delivered or posted to the last known address of the company in New Zealand.

The company shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on its part.

In case the company shall—
(1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
(2.) Cease to use or occupy the said wharf and shed for a period of thirty days;
(3.) Be in any manner wound up or dissolved; or
(4.) Fail to pay the sums specified in clause 3 of these conditions,—
then and in either of the said cases this Order in Council, and every license, right, power, or privilege, may be revoked and determined by the Governor-General in Council without any notice to the company or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the company, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

At the Government House at Wellington, this eighth day of October, 1917.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the fourteenth day of October, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 90, of the seventeenth day of the same month, His Excellency the Governor-General in Council did, in pursuance of the provisions of the Harbours Act, 1908, license Edmund Stratford, William Goss, and David Tennent, trading under the style or firm of “The Mount Radiant Sawmilling Company” at Karamea, to use and occupy a part of the foreshore and land below low-water mark of the Karamea River in order to maintain thereon a wharf erected in accordance with plan marked M.D. 3078, and deposited in the office of the Marine Department at Wellington, and upon and subject to the terms and conditions therein set forth :
And whereas it is desirable that the said license should be revoked for non-payment of the rent by the licensees :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke and determine the said recited Order in Council of the fourteenth day of October, one thousand nine hundred and seven, and the rights and privileges thereby conferred.

Portion of the Brightwater—Waimea West Main Road, in the Waimea County, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government House at Wellington, this fifteenth day of October, 1917.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council :
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General, by Order in Council, thinks fit to impose :
And whereas the Waimea County Council, being the local authority having control of the portion of road described in the Schedule hereto, has passed the following resolution—viz., “The Waimea County Council, being the local authority having control over that portion of the Brightwater—Waimea West Main Road fronting Section 154, Block V, Waimea Survey District, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said portion of the Brightwater—Waimea West Main Road” :
And whereas it is deemed expedient that such resolution should be approved :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
ALL that portion of the Brightwater Waimea West Main Road in the Nelson Land District, Waimea County, adjoining Section 154, Block V, Waimea Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 42895, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
