Land and Loan Notices

Aug. 23.] THE NEW ZEALAND GAZETTE. 3289

1913, take a poll of the ratepayers of the said County Council on a proposal of the said County Council to raise a loan of one thousand one hundred pounds (£1,100), for the purpose of constructing an additional reservoir and filter-bed and cleaning out the existing pipe service connected with the Lansdowne High-pressure Water-supply, and discharging the remaining liability amounting to two hundred and sixty-five pounds ten shillings and seven pence (£265 10s. 7d.): And whereas the said poll was duly carried, and the said County Council is desirous of borrowing the sum of one thousand one hundred pounds (£1,100) so authorized by the poll of the ratepayers as aforesaid: And whereas irregularities or defects occurred both in the notices published in pursuance of section nine of the said Act and in the voting-paper used at the poll upon the said proposal, in that the term of the said loan (namely, thirty-six and one-half years) was not set forth in such notice and voting-paper, nor was provision made for the repayment thereof by a sinking fund of one pound per centum per annum: And whereas it appears that the ratepayers of the said County Council have not been misled by such irregularities or defects, and it is expedient to validate the said proceedings:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities conferred upon him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that all proceedings in connection with the said poll shall be valid to all intents and purposes as though the said term had been published as required by section thirty-three of the said Act and provision had been made for the said sinking fund, and that the said proceedings shall not be called into question by reason only of the said irregularities or defects.

J. F. ANDREWS,
Clerk of the Executive Council.
