marked P.W.D. 39410, deposited in the office of the Minister
of Public Works at Wellington, in the Wellington Provincial
District, and thereon coloured blue and marked B C.

Radnor Street, St. Albans Ward, in the City of Christchurch,
exempted from the Provisions of Section 117 of the Public
Works Act, 1908, subject to a Condition as to the Building-
line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this thirty-first
day of January, 1916.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING
IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it is,
inter alia, provided that the said section shall not apply in
any case where the local authority having control of any
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or any
specified part thereof, and such resolution is approved by
the Governor in Council:

And whereas by subsection two of section one hundred and
seventeen of the Public Works Act, 1908, it is provided that
such approval may be either absolute or subject to such
conditions with respect to the building-line as the Governor,
by Order in Council, thinks fit to impose:

And whereas the Christchurch City Council, the local
authority having control of the street described in the Sche-
dule hereto, has passed the following resolution—viz., "That
the Christchurch City Council, being the local authority having
control of Radnor Street, St. Albans Ward, of the City of
Christchurch, hereby resolves that the provisions of section
one hundred and seventeen of the Public Works Act, 1908,
shall not apply to the said street":

And whereas it is deemed expedient that such resolution
should be approved, subject to the condition hereinafter
mentioned:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by the above-in-part-recited Act, and act-
ing by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution, subject to the condition that no building or
part of a building shall at any time be erected on either side
of the said street within a distance of thirty-three feet from
the centre-line of the said street.

SCHEDULE.
ALL that street in the Canterbury Land District, City of
Christchurch, St. Albans Ward, known as Radnor Street,
commencing at its junction with Springfield Road, and pro-
ceeding thence in an easterly direction generally and termi-
nating at its junction with Dover Street. As the said street
is more particularly delineated on the plan marked P.W.D.
39185, deposited in the office of the Minister of Public Works
at Wellington, in the Wellington Provincial District, and
thereon coloured red.

Martin's and Harley's Roads, in the Stoke Road District,
exempted from the Provisions of Section 117 of the Public
Works Act, 1908.

resolved that the existing road (Charles Martin's family
trust) is, in the opinion of the Board, of sufficient width for
all necessary traffic, and the provisions of section one hundred
and seventeen of the Public Works Act should not apply to
this road":

And whereas it is deemed expedient that such resolution
should be approved:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
approve of the said resolution.

SCHEDULE.
ALL that road in the Nelson Land District, Stoke Road
District, known as Martin's Road, commencing at its junc-
tion with Harley's Road, and proceeding thence in a north-
easterly direction adjoining or passing through Sections IV
and 86, Block III, Waimea Survey District.

Also all that road, in the said land district and road dis-
trict, known as Harley's Road, commencing at its junction
with Martin's Road, and proceeding thence in a north-
westerly direction adjoining or passing through part Sec-
tion IV, Block III, Waimea Survey District.

As the said portions of roads are more particularly deline-
ated on the plan marked P.W.D. 39313, and deposited in the
office of the Minister of Public Works at Wellington, in the
Wellington Provincial District, and thereon coloured red.

Portion of the South-eastern Side of District Road, in the
Borough of Mornington, exempted from the Provisions of
Section 117 of the Public Works Act, 1908, subject to a Con-
dition as to the Building-line.

Amendment Act, 1911, it is provided that such approval may
be either absolute or subject to such conditions as the
Governor in Council thinks fit to impose, and may refer to
one or both sides of the road or street:

And whereas the Mornington Borough Council, the local
authority having control of the portion of street described
in the Schedule hereto (hereinafter referred to as "the said
portion of street") has passed the following resolution—
viz., "That the Mornington Borough Council do hereby re-
solve that the provisions of section one hundred and seventeen
of the Public Works Act, 1908, shall not apply to that portion
of District Road fronting Sections 15, 16, and 17, Block VI,
Belleknowes, in the Borough of Mornington, as shown on the
attached plan":

And whereas it is deemed expedient that such resolution
should be approved in so far only as it refers to the south-
eastern side of the said portion of street, subject to the
condition hereinafter mentioned:
