Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no new buildings or part of a building shall be erected at any time on the south-eastern side of the said portion of street within a distance of thirty-three feet of the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of District Road, in the Otago Land District, Borough of Mornington, adjoining Allotments 15, 16, and 17, Block VI, Belleknowes Estate. As the said portion of street is more particularly delineated on the plan marked P.W.D. 39379, deposited in the office of the Minister of Public Works at Wellington, in the Provincial District of Wellington, and thereon coloured blue.

Vesting a Public Library Reserve in the Papakura Town Board.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this thirty-first day of January, 1916.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a site for a public library: And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Papakura Town Board:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the fourth section of the Public Reserves and Domains Act, 1908, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Papakura Town Board, in trust, as a site for a public library.

SCHEDULE.

ALL that parcel of land in the Auckland Land District containing by admeasurement 1 rood 2 perches, more or less, and being Allotment 115, Section 11, of the Village of Papakura, in the Parish of Opaheke, Drury Survey District. Bounded towards the north-east by a road-line, 215 links; towards the south-east by Allotment 116, 200 links; towards the west by the Great South Road, 280 links; and towards the north-west by a road-line, 39 links: be all the aforesaid linkages more or less.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this thirty-first day of January, 1916.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by section forty-six of the Land Laws Amendment Act, 1913, it is enacted that the Governor may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1908:

And whereas the Land Board of the Auckland Land District has duly passed a resolution recommending that the portion of the Otaika Kauri-gum Reserve described in the Schedule hereto be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section forty-six of the Land Laws Amendment Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Otaika Kauri-gum Reserve described in the Schedule hereto shall, from the tenth day of February, one thousand nine hundred and sixteen, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

ALL that area in the Auckland Land District, situated in Block VI, Tangihua Survey District, containing 10 acres 2 roods 15 perches, more or less, being portion of Otaika Kauri-gum Reserve, set apart by Order in Council dated 20th December, 1898, and published in the New Zealand Gazette No. 93, of 21st December, 1898, page 2073. Bounded towards the north generally by part of Otaika Kauri-gum Reserve, 1580 links; towards the east generally by a public road forming part of the western boundary of Allotment 90, Maungatapere Parish, 1380 links; and towards the south-west by Crown land, 1840 links: be all the aforesaid linkages more or less. As the same is delineated on plan marked L. and S. 11/1679, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Plan 17954.)

SCHEDULE.

ALL that area in the Auckland Land District, situate in Block V, Hohoura East Survey District, and containing by admeasurement 2 acres, more or less. Bounded commencing at a point on the Te Kao-Waihopo Road, 1169930·1 links north and 781821·6 links west of Mount Eden Trig. Station; towards the north-east by the said road, 333·3 links; towards the south-east by a right line bearing 250° 54′ for a distance of 600 links; towards the south-west by a right line bearing 340° 54′, 333·3 links; and towards the north-west by a right line bearing 70° 54′, 600 links, to the point of commencement: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 6/6/79, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (Auckland Plan 18526.)
