Consenting to the Raising of Loans by certain Local Authorities from the State Advances Department.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:

And whereas application has been made for the consent of the Governor in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the loans set out in column B therein from the State Advances Office:

And whereas it is expedient that the precedent consent of the Governor in Council should issue:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing from the State Advances Department of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and shall operate accordingly as a consent of the Governor in Council to the raising of the loans hereby authorized.

Domain Board appointed to have Control of the Kohukohu Domain.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section forty of the Public Reserves and Domains Act, 1908 (hereinafter termed "the said Act"), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to Part II of the said Act, control of such domain:

And whereas by an Order in Council made on the fifth day of October, one thousand nine hundred and nine, and published in the New Zealand Gazette of the seventh day of October, one thousand nine hundred and nine, a Domain Board was appointed to control the Kohukohu Domain:

And whereas the period for which the said Board was appointed expired on the fourth day of October, one thousand nine hundred and sixteen:

And whereas it appears expedient to appoint a Domain Board to control the domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

ARTHUR POTTER,
GEORGE EDWIN HALLIWELL, and
JOHN NICHOLSON

to be the Kohukohu Domain Board, having the control of the land described in the Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Saturday, the twenty-eighth day of October, one thousand nine hundred and sixteen, at seven o’clock p.m., as the time when, and the Town Hall, Kohukohu, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

KOHUKOHU DOMAIN.

ALL that area in the Auckland Land District, being Sections Nos. 2 and 3, Town of Kohukohu (Government), and containing by admeasurement 1 rood 30 perches, more or less. Bounded towards the north by Maning Street, 307·6 links; towards the east by Section No. 4, 92·2 links; towards the south-east by Beach Road, 140·4 links; towards the south-west and south generally by Section No. 6, 111·3 links and 120 links, and by Section No. 5, 60 links; and towards the west by Section No. 1, 118·7 links, all of the aforesaid town: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. 1051, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Also all that area in the Auckland Land District, situated in Block X, Mangamuka Survey District, being a portion of the foreshore of the Hokianga River, and containing by admeasurement 11 acres 2 roods 11·3 perches, more or less. Bounded, commencing at peg XIIIA, towards the north-east and south-west by right lines bearing 110° 29′, distance 496·6 links, and 200° 29′, 2289·6 links, respectively; and towards the west generally by a public road, 740·3, 382·6, 551·1, 658·9, and 231·1 links, to the point of commencement: be all the aforesaid linkages more or less. As the same is delineated on the plan marked 1/64, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red. (Auckland Plan 14530.)
