✨ Government Regulations and Orders
Mar. 18.] THE NEW ZEALAND GAZETTE. 899
the Omataroa Riding at Mr. Spurr’s to the Rangitaiki River at Te Teko, and (b) of providing for the first year’s interest and sinking fund during the construction of the above work, and the cost of raising the loan, under the Local Bodies’ Loans Act, 1913:
And whereas the first notice of the poll of ratepayers taken on the proposal to raise the above loan was published only thirteen days before the date of the taking of the poll instead of not less than fourteen days before the said date as required by section ten (two) of the above-named Act:
And whereas the notice of the said poll as advertised in the Whakatane County Press on the first, sixth, eighth, and thirteenth July, one thousand nine hundred and fourteen, referred to a loan of five hundred pounds instead of a loan of five hundred and fifty pounds:
And whereas the reference to a loan of five hundred pounds is a misprint in the said advertisements:
And whereas it appears that the ratepayers have not been misled by such irregularities or defects, and that it is expedient to validate the same:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said proceedings and poll shall be valid to all intents and purposes as though the first publication of the notice setting forth the date of the said poll had been made within the proper time, and as though the four notices above referred to and advertised in the Whakatane County Press on the dates above mentioned had referred to a loan of five hundred and fifty pounds instead of a loan of five hundred pounds, and that the proceedings relative to such loan shall not be called in question by reason only of the irregularities aforesaid.
