Warrant authorizing the Thames County Council to construct a Ferry over the Thames River at Kopu, together with Approaches, Landing-dock, Caretakers’ Cottages, Sheds, Cattle-yards, and Telephone Service in connection therewith.

LIVERPOOL, Governor.

WHEREAS by section one hundred and nineteen of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is, inter alia, enacted that in any case where the local authority of any district desires to construct a bridge, or to establish a ferry or ford, in any position that will, in its opinion, be of advantage or benefit to the whole or any considerable portion of the inhabitants of an adjacent district, as well as to the inhabitants of its own district, and where it is, in the opinion of such local authority, reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing the said bridge, ferry, or ford, the provision of the said section shall have effect:

And whereas section one hundred and nineteen of the said Act has been amended by section four of the Public Works Amendment Act, 1908, so as to enable the Governor to authorize the work to be executed either as originally proposed or with such alterations as are recommended by the Commission:

And whereas the Thames County Council has given notice and taken the steps required by the said Act, and has made application to the Governor to authorize the construction by the said Council of the ferry, together with approaches, landing-dock, caretakers’ cottages, sheds, cattle-yards, and telephone service in connection therewith, as more particularly described in plan and specification marked P.W.D. 36942, and hereinafter referred to as “the said work,” and to apportion the cost of constructing and establishing the said work between the Thames County Council and the Thames Borough Council:

And whereas objections were made to the Governor within the period of two months prescribed by paragraph (a) (iii), subsection two, of the said section one hundred and nineteen:

And whereas it is also provided in the said section one hundred and nineteen that the Governor (with the view of determining whether or not the work should be done, or what proportion, if any, of the cost of the same should fairly be borne by any local authority, or what local authority should do the work) may direct any Magistrate or other person to be a Commissioner to inquire into and report to him on the matter:

And whereas a Commission was appointed, and an inquiry was duly held in the manner provided by the said Act and the Commissions of Inquiry Act, 1908, in respect of the said work, and in respect also to the apportionment of the cost of constructing the said work:

And whereas such Commission did report to the Governor, after due inquiry, its opinion as to the matters respecting which it was appointed to report, and recommended that instead of the work originally proposed the work described in the Schedule hereto should be carried out:

And whereas I am of opinion that the work as recommended should be done, and it is expedient to make provision under the said Act for the purpose and in the manner hereinafter set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby authorize the Thames County Council to execute the work as recommended by the Commission; and I do hereby declare that the cost thereof, less such contribution as may be made thereto (if any) by the Government of New Zealand, shall be borne by the Thames County Council and the Thames Borough Council in the following proportions—viz., the Thames County Council to bear sixty per centum and the Thames Borough Council to bear forty per centum of such cost respectively.

And I do hereby direct that any contribution hereby required to be made as aforesaid by the Thames Borough Council shall be paid from time to time in the proportion hereinbefore prescribed, out of the funds of the said Council, within a period of one month after a demand in writing made by or on behalf of the Thames County Council, and such payments shall be made from time to time to the Clerk of the Thames County Council for and on account of the said Borough Council.

SCHEDULE.

The work hereinbefore referred to consists of—

(1.) An approach on the eastern side at Princess Street, Kopu, consisting of eight spans of 20 ft. each, built similar in design to the approach shown on plan marked P.W.D. 38455, and joined to a sloped timber-decked dock 165 ft. long by 30 ft. wide consisting of eleven spans of 15 ft. each on a grade of 1 in 15, with guide-piles on each side as shown on P.W.D. 38457.

(2.) An approach on the western side (at a place selected) on the naturally formed river-bank of about 1 in 15 grade, trimmed and fascined with two cross-laid coats of fascines, wired over and pegged down, with guide-poles on sides, and fencing as on eastern side; such approach to be 30 ft. wide and 165 ft. long, and to be covered with heavy stone pitching and 9 in. of approved gravel on top. The road from the top of the river-bank to the approach is also to be covered with heavy stone pitching and 9 in. of approved gravel on top.

(3.) A 25 horse-power towing oil-launch about 35 ft. long by about 9 ft. beam, drawing about 12 in. to 18 in. of water, with either a tunnel or other suitable arrangement for protecting the screw when working in shallow water.

(4.) A cattle or ferry punt similar to the Mititai Ferry Punt on the Northern Wairoa River, near Aratapu, as shown on P.W.D. 38457.

(5.) Cattle-yards, shelter-sheds, caretakers’ cottages, and telephone service, in accordance with the plans and specifications submitted to the Minister of Public Works by the Thames County Council in pursuance of section 119 of the Public Works Act, 1908, and marked P.W.D. 36942.

As the said plans are deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District.

Notice exempting Crown Lands from the Operation of the Mining Act, 1908.

LIVERPOOL, Governor.

IN pursuance and exercise of the powers and authorities vested in me by the Mining Act, 1908, and of every other power and authority enabling me in that behalf, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby exempt the lands referred to and described in the Schedule hereto from the operation of the Mining Act, 1908.

SCHEDULE.

ARDLUSSA SETTLEMENT.

ALL those areas of land in the Southland Land District, containing together by admeasurement 12,915 acres 2 roods 20 perches, more or less, situated in Blocks II, III, IV, and VII, Hokonui Survey District, being Sections 1 to 7, both inclusive, on the plan of Ardlussa Settlement; as the said sections are delineated on the plan marked L. and S. 19454, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon edged with green.

As witness the hand of His Excellency the Governor, this twenty-fourth day of August, one thousand nine hundred and fifteen.

Postmasters appointed to take and receive Statutory Declarations.

PURSUANT to the authority conferred upon me by the two-hundred-and-eighty-eighth section of the Justices of the Peace Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby notify and declare that the persons set out in the Schedule hereto, being persons holding the office of Postmaster under the Post and Telegraph Act, 1908, at the places set opposite their names in the said Schedule, are authorized to take and receive statutory declarations under the two-hundred-and-eighty-eighth section of the Justices of the Peace Act, 1908.
