Portions of the Western Side of Forth Street, the Eastern Side of Leith Walk, and the Northern and Southern Sides of Princes Street, Portobello, Otago, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this second day of November, 1914.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Portobello Road Board, the local authority having control of the portions of roads described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portions of roads:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the western side of portion of Forth Street, the eastern side of portion of Leith Walk, and northern and southern sides of portions of Princes Street, as described in the Schedule hereto, subject to the conditions hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the conditions that on the said respective sides of such portions of roads no building or part of a building shall be erected at any time within thirty-three feet of the centre-line of the said portions of roads.

SCHEDULE.

Those portions of the western side of Forth Street, in the Township of Portobello, Otago Land District, adjoining Allotments 4, 14, and 16, Block IV, and Allotment 2, Block VIII, Township of Portobello, being a distance of 4 chains, more or less.

Also that portion of the eastern side of Leith Walk, in the said township and land district, adjoining Allotments 13, 15, and 17, Block IV, and Allotment 1, Block VIII, Township of Portobello, being a distance of 4 chains, more or less.

Also those portions of the northern side of Princes Street, in the said township and land district, adjoining Allotment 17, Block IV, being a distance of 2½ chains, more or less. And the southern side, adjoining Allotments 1 and 2, Block VIII, Township of Portobello, being a distance of 5 chains, more or less.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 36274, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured yellow.

Revoking Order in Council licensing the Pelorus Refrigerating Fisheries and Supply Company (Limited) to use and occupy a Part of the Foreshore and Land below Low-water Mark of Forsyth Bay, Pelorus Sound, as a Site for a Wharf.

ORDER IN COUNCIL.
At the Government House at Wellington, this second day of November, 1914.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the twenty-eighth day of July, one thousand nine hundred and three, and published in the New Zealand Gazette No. 62, of the sixth day of August following, His Excellency the Governor in

Council did, in pursuance of the provisions of the Harbours Act, 1908, license the Pelorus Refrigerating Fisheries and Supply Company (Limited) to use and occupy a part of the foreshore and land below low-water mark of Forsyth Bay, Pelorus Sound, in order to maintain thereon a wharf erected in accordance with plan marked M.D. 2642 (two sheets), and deposited in the office of the Marine Department at Wellington, and upon and subject to the terms and conditions therein set forth: And whereas it is desirable that the said license should be revoked:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke and determine the said recited Order in Council of the twenty-eighth day of July, one thousand nine hundred and three, and the rights and privileges thereby conferred, and doth order that such revocation shall take effect as from the thirtieth day of June, one thousand nine hundred and fourteen.

Lands temporarily reserved for a Rifle Range in Cambridge Survey District, Auckland Land District.

LIVERPOOL, Governor.

WHEREAS by the three-hundred-and-twenty-first section of the Land Act, 1908, it is enacted that the Governor may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

And whereas by the sixty-ninth section of the Land for Settlements Act, 1908, it is further provided that the Governor may from time to time, as he thinks fit, set aside reserves for any specified public purpose out of land acquired under the last-mentioned Act, provided that no land so acquired shall be set aside for endowments:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Acts, do hereby temporarily reserve from sale the lands in the Auckland Land District described in the Schedule hereunder written, for a rifle range.

SCHEDULE.

ALL that area in the Auckland Land District, containing 11 acres 1 rood 32 perches, more or less, being part of Section 11, Block X, Cambridge Survey District (Karapiro Settlement). Bounded towards the north-east and south-east by part of Section 11, Block X, Cambridge Survey District, 336·5, 470·3, 184·2, 272·9, 155·8, 190·9, 130·1, and 1160·9 links; and towards the west generally by a stream and by a public road, 205 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 1911/505A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Also all that area in the Auckland Land District, containing 112 acres, more or less, being Section 10, Block IX, Cambridge Survey District (Karapiro Settlement). Bounded towards the north-east and south-east by a public road 4775·9, 1812·1, 1356·1, and 980·1 links; and towards the south-west by the Waikato River and by Cambridge East Town Belt Section 44, 1045·8 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 1911/505B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
