SCHEDULE.

MONKEY FACE DOMAIN.

ALL that area in the Marlborough Land District, containing
by admeasurement 333 acres, more or less, being Section No. 5,
Block III, Hundalee Survey District. Bounded towards the
north-west by a one-chain road, 3100 links and 5551 links ;
towards the east by Section No. 6, Block III, Hundalee
Survey District, 2848·3 links and 468·7 links ; towards the
south-east by the Tukutukuwi Road, 10400·2 links ; and
towards the south-west partly by Small Grazing-run No. 156
and partly by Section No. 59, Block III, Hundalee Survey
District, 6920·9 links : be all the aforesaid linkages more
or less : as the same is delineated on the plan marked
L, and S. 1263/8A, deposited in the Head Office, Department
of Lands and Survey, at Wellington, and thereon bordered
red.

exempted from the Provisions of Section 117 of the Public
Works Act, 1908.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of
September, 1913.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it
is, inter alia, provided that the said section shall not apply
in any case where the local authority having control of any
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council ;

And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is provided
that such approval may be either absolute or subject to such
conditions with respect to the building-line as the Governor,
by Order in Council, thinks fit to impose :

And whereas the Waihemo and Waikouaiti County Coun-
cils, being the local authorities having control of the road
described in the Schedule hereto, did by resolutions declare
that the provisions of the said section one hundred and
seventeen should not apply to the said road :

And whereas it is deemed expedient that such resolutions
should be approved :

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolutions, in so far as they affect the said road de-
scribed in the Schedule hereto.

ALL that road in the Waihemo and Waikouaiti Counties,
Otago Land District, known as Middle Mount Road, Mount
Royal Estate, commencing at its junction with a road 1 chain
in width in Section 13, Mount Royal Estate, Block VIII,
Hawksbury District, and running in a north-easterly direc-
tion generally through or adjoining Sections 13, 5, and 13,
Mount Royal Estate, in the said Block VIII, Sections 38,
39, 40, 41, 42, 36, 43, 35, 1 of 44, 981R, 34, 33, 2 of 30, Mount
Royal Estate, Block VII, Hawksbury District, Section 65,
Mount Royal Estate, Block V, Moeraki Survey District,
Section 31, Mount Royal Estate, Block VII, Hawksbury
District ; thence in a south-easterly direction generally
through or adjoining Sections 32, 988R, and 32, Mount Royal
Estate, Block VII, Hawksbury District, Sections 71, 2 of 72,
and 69, Mount Royal Estate, Block V, Moeraki District :
as the said road is more particularly delineated on the plan
marked P.W.D. 33865, and deposited in the office of the
Minister of Public Works, at Wellington, in the Wellington
Provincial District, and thereon coloured red.

Validating Proceedings in connection with the Clifton County
Council’s Loan of £3,995.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of
September, 1913.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Clifton County Council lately proposed
to raise a loan of three thousand nine hundred and
ninety-five pounds, under the Local Bodies’ Loans Act, 1908,
and amendments thereof, for the purpose of renewing bridges
in the County of Clifton :

And whereas the notice of intention to raise the said loan,
although published four times, was not published once in
each week for four successive weeks, as required by section
eight of the Local Bodies’ Loans Act, 1908 :

And whereas it appears the ratepayers in the said county
have not been misled by such irregularity or defect, and it
is expedient to validate the said proceedings :

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
powers conferred by section one hundred and twenty-one of
the Local Bodies’ Loans Act, 1908, as amended by section
seven of the Local Bodies’ Loans Amendment Act, 1910, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby declare that the
said proceedings shall be valid to all intents and purposes
as though the said public notifications had been properly
given, and that the proceedings in connection with the said
loan shall not be called in question by reason only of the
irregularity aforesaid.

Consenting to a Mortgage of Native Land.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of
September, 1913.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two hundred and thirty of the
Native Land Act, 1909, it is provided that no instru-
ment of alienation of Native land by way of mortgage or
charge, other than a mortgage or charge in favour of a State
Loan Department, shall be confirmed by a Board or the
Court without the precedent consent of the Governor in
Council :

And whereas application has been made for the consent of
the Governor in Council to a mortgage of the block or parcel
of land mentioned in the Schedule hereto : And whereas it
is expedient that the precedent consent of the Governor in
Council should issue :

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby consent to the confirmation of an alienation by
way of mortgage of the block or parcel of land set out in
the Schedule hereto. And it is hereby declared that this
Order in Council is made under the provisions in that
behalf of the Native Land Act, 1909, and shall operate
accordingly as a consent of the Governor in Council to the
proceedings hereby authorized.
