ANDREWS,\nClerk of the Executive Council.\n\nExempting Railway Reserve Road, in the Borough of Gisborne,\nfrom the Provisions of Section 117 of the Public Works Act,\n1908, subject to certain Conditions as to the Building-line.\n\nLIVERPOOL, Governor.\nORDER IN COUNCIL.\nAt the Government House, at Wellington, this twenty-seventh\nday of January, 1913.\n\nPresent :\nHis Excellency the Governor in Council.\n\nWHEREAS by subsection one of section one hundred\nand seventeen of the Public Works Act, 1908, it is,\ninter alia, provided that the said section shall not apply in\nany case where a local authority having control of a road\nor street declares that the provisions thereof shall not apply\nto any specified road or street, or any specified part thereof,\nand such resolution is approved by the Governor in Council :\nAnd whereas by subsection two of section one hundred\nand seventeen of the Public Works Act, 1908, it is, inter\nalia, provided that such approval may be either absolute or\nsubject to such conditions as the Governor by Order in\nCouncil thinks fit to impose :\nAnd whereas the Gisborne Borough Council, the local\nauthority having control of the street described in the Sche-\ndule hereto, did, on the third day of September, one thou-\nsand nine hundred and twelve, by resolution declare that the\nprovisions of the said section one hundred and seventeen\nshould not apply to the said street: And whereas it is\ndeemed expedient that such resolution should be approved,\nsubject to the conditions hereinafter mentioned :\nNow, therefore, His Excellency the Governor of the Do-\nminion of New Zealand, in pursuance and exercise of the\npowers conferred by the above-in-part-recited Act, and acting\nby and with the advice and consent of the Executive Council\nof the said Dominion, doth hereby approve of the said reso-\nlution, subject to the condition that no building or part of a\nbuilding shall at any time be erected on either side of the\nsaid street within a distance of thirty-three feet from the\ncentre-line of the said street.\n\nSCHEDULE.\n\nALL that street in the Borough of Gisborne, Hawke’s Bay\nLand District, known as Railway Reserve Road, commencing\nat its junction with Fitzherbert Street, and proceeding in a\nnorth-westerly direction, adjoining Sections Nos. 23, 27, 28,\nLots Nos. 3, 2, 1 of Section No. 128, Sections Nos. 40, 39,\n38, 37, 97, 96, 95, 94, 93, 92, 91, and 90, Block A, 55, 53, 52,\n51, 50, 49, 48, 47, 46, 45, 44, 43, 42, 41, and 40, Block B,\n40, 39, 38, 37, 36, 35, 34, 33, 32, 31, 70, 69, 68, 67, 66, 65, 64\n63, 62, 61, Block C, 140, and 141, adjoining Ormond Road,\nand terminating at a point at the northern corner of the\nsaid Section No. 141, being a distance of one mile, more or\nless; as the said street is more particularly delineated on\nthe plan marked P.W.D. 32967, deposited in the office of the\nMinister of Public Works, at Wellington, in the Wellington\nProvincial District, and thereon coloured red.\n\nJ. ANDREWS,\nClerk of the Executive Council.\n\nExempting Portion of Moss Street, in the Borough of Grey-\nmouth, from the Provisions of Section 117 of the Public\nWorks Act, 1908.\n\nLIVERPOOL, Governor.\nORDER IN COUNCIL.\nAt the Government House, at Wellington, this twenty-seventh\nday of January, 1913.\n\nPresent :\nHis Excellency the Governor in Council.\n\nWHEREAS by subsection one of section one hundred\nand seventeen of the Public Works Act, 1908, it is,\ninter alia, provided that the said section shall not apply in\nany case where the local authority having control of any\nroad or street by resolution declares that the provisions\nthereof shall not apply to any specified road or street, or\nany specified part thereof, and such resolution is approved\nby the Governor in Council :\nAnd whereas by subsection two of section one hundred\nand seventeen of the Public Works Act, 1908, it is provided\nthat such approval may be either absolute or subject to such\nconditions with respect to the building-line as the Governor\nby Order in Council thinks fit to impose :\nAnd whereas the Greymouth Borough Council, being the\nlocal authority having control of the portion of street de-\nscribed in the Schedule hereto, did on the twenty-first day\nof November, one thousand nine hundred and twelve, by\nresolution declare that the provisions of the said section one\nhundred and seventeen should not apply to the said portion\nof street :\nAnd whereas it is deemed expedient that such resolution\nshould be approved :\nNow, therefore, His Excellency the Governor of the Do-\nminion of New Zealand, in pursuance and exercise of the\npowers conferred by the above-in-part-recited Act, and acting\nby and with the advice and consent of the Executive Council\nof the said Dominion, doth hereby approve of the said reso-\nlution in so far as it affects the said portion of street described\nin the Schedule hereto.\n\nSCHEDULE.\n\nALL that portion of street in the Borough of Greymouth,\nknown as Moss Street, abutting on Section 359 (being part\nof Native Reserve 31), Town of Greymouth; as the said\nportion of street is more particularly delineated on the plan\nmarked P.W.D. 32814, deposited in the office of the Minister\nof Public Works, at Wellington, in the Provincial District of\nWellington, and thereon shown edged green.\n\nJ.
