Declaring Cross Road, Kumeti Block, in the Dannevirke County, to be a County Road.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of November, 1912.

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.


SCHEDULE.

ALL that portion of road in the Hawke’s Bay Land District, Dannevirke County, known as Cross Road, Kumeti Block, commencing at its junction with the Kumeti Road on the north-western boundary of Section 10, Block XII, Norsewood Survey District, and proceeding thence in a north-easterly direction along the south-eastern boundary of Sections 7 and 6, Block XII, Norsewood Survey District, to the southernmost corner of Section 5, Block XII, Norsewood Survey District, being a distance of 1 mile 13 chains, more or less ; as the said road is more particularly delineated on the plan marked P.W.D. 32741, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Incorporating the Glencairn Land-settlement Association.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of November, 1912.

Present :

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

WHEREAS by section seven of the Land Settlement Finance Act (hereinafter referred to as “the said Act”) it is provided that, as soon as possible after the complete execution of any agreement under the said Act, application in the prescribed form shall be made to the Governor by or on behalf of the purchasers for an Order in Council confirming the agreement in pursuance of the said Act: And whereas by sections eight and nine of the said Act it is further provided that upon receipt of such application the Minister of Finance shall refer the same, together with the agreement, to the Board of Land Purchase Commissioners for its report thereon, and if the Board reports that the agreement is fit and proper to be so confirmed the Governor may, if he thinks fit, by Order in Council confirm the agreement accordingly: And whereas under the provisions of the said Act an agreement, bearing date the eighteenth day of June, one thousand nine hundred and twelve, has been entered into between James Bruce, vendor, of the one part, and Joseph William Windelborn (Catherine Kennedy Quin and Evelyn Stanley Quin, as tenants in common in equal shares), Arthur Henry Braithwaite, Walter Beard, Frederick William Goebel, Henry James Dawbin, Hugh Beard, William Henry Austin, William Baden Winchcombe, Arthur Findlay, and William Henry Emmerson, as purchasers, of the other part, for the purchase of the land therein described, and the said purchasers therein agreed to become incorporated as the Glencairn Land-settlement Association : And whereas application has been made in the prescribed form for the issue of an Order in Council confirming the said agreement: And whereas the said application, together with the said agreement, was referred to the Board of Land Purchase Commissioners for its report, and the Board has reported that no reading is required in respect of the said land, and that the said agreement is fit and proper to be so confirmed:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by the said Act, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby confirm the said agreement dated the eighteenth day of June, one thousand nine hundred and twelve.

Withdrawing Land from the Operation of the Kauri-gum Industry Acts.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of November, 1912.

Present :

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

WHEREAS by section thirty-three of the Kauri-gum Industry Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may by Order in Council declare that land set apart under the said Act as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the said Act, and thereupon the land shall cease to be a kauri-gum reserve, and shall be dealt with by the Land Board as ordinary Crown land ; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary :

And whereas the Land Board of the Auckland Land District passed a resolution recommending that the portion of the Tatarariki No. 5 Kauri-gum Reserve described in the Schedule hereto be declared to be no longer subject to the said Act, and such resolution was duly gazetted and publicly notified in accordance with section nine of the Kauri-gum Industry Amendment Act, 1910 : And whereas no objection has been received to the said proposal :

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the Kauri-gum Industry Act, 1908, and section nine of the Kauri-gum Industry Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Tatarariki No. 5 Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.


SCHEDULE.

ALL that area in the Auckland Land District, being portion of Allotment No. 41, Tatarariki Parish (Block X, Tokatoka Survey District), Hobson County, containing by admeasurement 5 acres, more or less, and being portion of Tatarariki No. 5 Kauri-gum Reserve set apart by Order in Council dated 16th February, 1905, and published in the New Zealand Gazette No. 16, of 23rd February, 1905, page 535. Bounded towards the north-east by a public road 100 links wide, 165-6 and 339-5 links ; towards the south-east by a public road 100 links wide, 985-5 links ; and towards the south-west and north-west by other part of Allotment No. 41, Tatarariki Parish, Tatarariki Kauri-gum Reserve No. 5, 499-7 and 1039-1 links respectively : be all the aforesaid linkages more or less : as the same is delineated on the plan marked L. 1912/554A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
