Regulation under the New Zealand State-guaranteed Advances Act, 1909 (Advances to Local Authorities).

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty sixth day of November, 1912.

Present:

THE HONOURABLE J. ALLEN PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by the New Zealand State-guaranteed Advances Act, 1909, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation; and doth declare that this regulation shall come into force on the date of the publication thereof in the New Zealand Gazette.

REGULATION.

THE resolution to be passed by a local authority as provided by subsection (1) of section 3 of the New Zealand State-guaranteed Advances Amendment Act, 1912, shall be in the following form, or as near thereto as the circumstances will permit:—

Whereas the [Name of local authority] has been authorized by the ratepayers to borrow [Amount of loan] for the purpose of [State purpose], and the New Zealand State-guaranteed Advances Board has provisionally approved [or finally granted] the application for such loan at the rate of £ __ per centum per annum: And whereas the New Zealand State-guaranteed Advances Office Superintendent is unable to advance such loan [or part of such loan], namely, £ __, at the said rate of interest, but can advance the same at the rate of £ __ per centum per annum: Now, in pursuance and exercise of the powers vested in it in that behalf by the Local Bodies’ Loans Act, 1908, and section 4 of the Local Bodies’ Loans Amendment Act, 1910, the [Name of local authority] hereby resolves that for the purpose of providing moneys sufficient to cover the increased payments in respect of such loan [or such part of such loan], namely, £ __, the said [Name of local authority] hereby makes and levies a special rate of [State amount in the pound] upon the rateable value of all rateable property of the [Name of district or special-rating area], comprising [Name the district—e.g., the whole of the County of __; or, in the case of a special-rating area, name the ward, riding, or other statutory subdivision comprising the same; or, if not such a subdivision, describe by its boundaries, and state the numbers of the sections and block comprising the same, and name of survey district. If the special-rating area has no specific name, refer to it as “special-rating area”]; and that such special rate shall be an annual-recurring rate during the currency of such [or such part of such] loan, and be payable half-yearly on the __ day of __ and the __ day of __ [or yearly on the __ day of __] in each and every year during the currency of such [or such part of such] loan, being a period of [State number] years, or until such [or such part of such] loan is fully paid off.

Bringing certain Provisions of the Mining Act into Force within certain Parts of New Zealand.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of November, 1912.

Present:

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

WHEREAS by section two of the Mining Amendment Act, 1911, it is provided that the Governor, by Order in Council, may from time to time declare that any of the provisions of the Mining Act, 1908, shall apply to prospecting and mining for and the storage of petroleum and other mineral oils and of natural gas, and also define the districts within which any such Order in Council shall take effect:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by the said Act, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the provisions of the Mining Act, 1908, set out in the First Schedule hereto shall apply to prospecting and mining for and the storage of
