Consenting to a Mortgage of Native Land.
ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of October, 1912.

THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
WHEREAS by section two hundred and thirty of the Native Land Act, 1909, it is provided that no instrument of alienation of Native land by way of mortgage or charge, other than a mortgage or charge in favour of a State Loan Department, shall be confirmed by a Board or the Court without the precedent consent of the Governor in Council:
And whereas application has been made for the consent of the Governor in Council to a mortgage of the block or parcel of land mentioned in the Schedule hereto: And whereas it is expedient that the precedent consent of the Governor in Council should issue:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the confirmation of an alienation by way of mortgage of the block or parcel of land set out in the Schedule hereto. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Exempting a Native from the Provisions of the Native Land Act, 1909, with respect to Landless Natives, and consenting to the Confirmation of an Alienation by the Maori Land Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of October, 1912.

WHEREAS by section four hundred and twenty-five of the Native Land Act, 1909, it is enacted that—
- The Governor may by Order in Council, in any case in which he thinks it expedient so to do, consent to the confirmation of any alienation, or to the confirmation of any resolution of assembled owners, or to any purchase by the Native Land Purchase Board, or to any exchange of Native land, notwithstanding the fact that any Native may thereby become landless within the meaning of this Act; and thereupon the said confirmation, purchase, or exchange may take place and shall have effect in the same manner as if that Native retained Native freehold land sufficient for his adequate maintenance:
- No such consent shall be given except on the recommendation of the Native Land Court or of the Maori Land Board of the district in which the land is situated:
- No such consent shall be given unless the Governor is satisfied that the said Native is able to maintain himself by his own means or labour, and that the transaction consented to is not contrary to the public interest:
And whereas to enable confirmation of a sale by the owners of Parish of Horotiu No. 16A (Gordon), the Waikato-Maniapoto District Maori Land Board recommends that such consent shall be given: And whereas it is expedient so to do:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby consent to the confirmation of the aforesaid sale, notwithstanding the fact that the Natives may thereby become landless within the meaning of the said Act. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Appointing Day on which Land-tax shall be payable.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of October, 1912.
Present:
THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authority vested in him under the Land and Income Assessment Act, 1908, and the Land-tax and Income-tax Act, 1912, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and determine that the respective duties leviable under the said Acts by way of land-tax, and of further graduated land-tax, shall be paid in one sum on Monday, the second day of December, one thousand nine hundred and twelve.
And in further pursuance and exercise of the powers and authority aforesaid, and with the like advice and consent as aforesaid, His Excellency doth also determine that the place where the said duties of land-tax shall be payable shall be the office of the Commissioner of Taxes, at the Government Buildings, Wellington, and that notice to the foregoing effect shall be given by the said Commissioner accordingly.

Opening Lands in Otago Land District for Sale or Selection.
ISLINGTON, Governor.
IN pursuance and exercise of the powers and authorities conferred upon me by the Land Act, 1908, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, having received the report of the Under-Secretary in this behalf, as provided by section one hundred and fifty-four of the said Act, do hereby declare that the lands described in the Schedule hereto shall be open for sale or selection on Tuesday, the eleventh day of February, one thousand nine hundred and thirteen; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase, or on renewable lease; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of the Land Act, 1908.

Rough bush sections, slightly broken by a number of gullies. Soil of fair quality; no surface water in dry seasons. Situated about three miles and a half from Kaka Point School and Post-office. Road access to near the north-east corner of Section 21.

Weighted with £6 5s., valuation for improvements consisting of bushfelling.
A bush section, with a fair aspect. The bush is of a mixed nature, and contains a good deal of heavy kamai. The section is well watered, and has a very fair soil. Situated about six miles from Glenomaru Railway-station, about three miles and a half from Ahuriri Post and Telephone Office, and about a mile and a quarter from a school. There is a good metalled road to within 25 chains of the section, and the formation has been carried on to the eastern boundary.
