Declaring Land taken for a Public Work, and not required
for such Public Work, to be Crown Land.

A PROCLAMATION.
WHEREAS it is provided by section thirty of the Public
Works Act, 1908, that if it is found that any land
held, taken, purchased, or acquired at any time under this
or any other Act or Provincial Ordinance, or otherwise how-
soever, for any public work is not required for such public
work the Governor may, by an Order in Council publicly
notified and gazetted, cause the same to be sold under the
conditions therein mentioned:
And whereas it is further provided by section five of the
Public Works Amendment Act, 1909, that in the case of
any land so purchased, taken, or acquired for a Government
work, and not required for that purpose, the Governor may,
on the recommendation of the Minister, and without com-
plying with any other requirements of the aforesaid section
thirty, by Proclamation declare such land to be Crown land
subject to the Land Act, 1908, and thereupon the land may
be administered and disposed of under that Act accordingly:
And whereas the land described in the Schedule hereto
was taken for a road: And whereas such road has been
closed, and it is desirable to declare the land contained there-
in to be Crown land: And whereas a plan has been pre-
pared, and the Minister has recommended the Governor to
declare such land to be Crown land:
Now, therefore, in pursuance and exercise of the powers
and authorities conferred upon me by the above-in-part-
recited Acts, and of all other powers in anywise enabling me
in this behalf, I, John Poynder Dickson-Poynder, Baron
Islington, the Governor of the Dominion of New Zealand,
do hereby declare the land described in the Schedule hereto
to be Crown land subject to the Land Act, 1908, and that
such land may be administered and disposed of under that
Act accordingly.

of Public Works, at Wellington, in the Wellington Provincial
District.

Chief in and over His Majesty's Dominion of
New Zealand and its Dependencies; and issued
under the Seal of the said Dominion, at the

Defining the Middle-line of a Further Portion of the East Coast
Main Trunk Railway (Gisborne Southwards).

A PROCLAMATION.
WHEREAS a portion of the East Coast Main Trunk
Railway—namely, from Gisborne southwards for a
distance of twenty-six miles (hereinafter termed "the said
railway ")—is a railway the construction of which was autho-
rized by the Railways Authorization Act, 1910: And whereas
the said railway has been partly constructed, and it has been
determined to construct and maintain a further portion of
the said railway described in the Schedule hereto:
Now, therefore, I, John Poynder Dickson-Poynder, Baron
Islington, the Governor of the Dominion of New Zealand, in
pursuance and exercise of the powers and authorities con-
ferred on me by section one hundred and eighty-eight of the
Public Works Act, 1908, and the Railways Authorization Act,
1910, and in pursuance and exercise of every other power
and authority in anywise enabling me in this behalf, do hereby
proclaim and declare that the middle-line of the said further
portion of the said railway shall be that defined and set forth
in the Schedule hereto.
SCHEDULE.
COMMENCING at [a point in]Section ;73, Block I, Turanganui
Survey District, marked 4 miles 4943·8 links, and proceeding thence in a westerly and then north-westerly direction
generally for a distance of about 7 miles 3056·2 links, and
passing in, into, through, or over the following lands, &c.—
viz., Sections 73 and 70, Block I, Turanganui Survey Dis-
trict; Sections 68, 67, 66, 65, 64, 63A (E.R.), 77, and 78,
Block IV, Patutahi Survey District; Repongaere A Block,
Blocks III and IV, Patutahi Survey District, and Block XV,
Waikohu Survey District; Section 84, Block III, Patutahi
Survey District; Okahuatiu No. 1E Block, Sections 6, 5, a
closed road, Sections 4, 3, and 1, Block XV, Waikohu Survey
District; and terminating at a point in the said Section 1,
Block XV, Waikohu Survey District, marked 12 miles : in-
cluding all adjoining and intervening places, lands, reserves,
roads, tracks, lakes, rivers, streams, and watercourses : all in
the Land District of Hawke’s Bay: as the same is delineated
on the plan marked P.W.D. 32071, deposited in the office of
the Minister of Public Works, at Wellington, in the Wel-
lington Provincial District.

Altering the Boundaries of Opotiki and Waikohu Counties.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
first day of October, 1912.
Present :
THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
WHEREAS, in exercise of the powers conferred by sec-
tion sixteen of the Counties Act, 1908 (hereinafter
termed “the said Act”), the Opotiki County Council and the
Waikohu County Council respectively did, by an instrument
bearing date the nineteenth day of July, one thousand nine
hundred and twelve, formally agree that the boundaries of
the said counties should be altered to the extent set forth in
the said instrument and also in the Schedule hereto : And
whereas it is expedient that such alteration of boundaries be
approved by the Governor in Council, and that such altered
boundaries be defined in terms of the said Act:
Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
power and authority conferred by the said Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that,
on and after the publication of these presents in the New
Zealand Gazette, the boundaries of the Counties of Opotiki
and Waikohu respectively shall be those set forth under
their respective headings in the Schedule hereto.

OPOTIKI COUNTY.
ALL that area bounded towards the north and north-west by
the Bay of Plenty from a point where the Maraetotara Road
first strikes high-water mark of the sea to the mouth of the
Whangaparoa River; thence towards the east generally by
the said Whangaparoa River to the northernmost corner of
Waikura No. 1 Block; thence by Waikura No. 1 and No. 2
Blocks to the south-western corner of the last-mentioned
