THE NEW ZEALAND GAZETTE.
No. 78

  1. Interpretation.—In this by-law the words “the bridge” shall mean the bridge (with its approaches) over the Ashley River connecting Ashley Street, Rangiora, with Comes Road, Ashley County.

“The Council” shall mean the Ashley County Council.

“The Surveyor” shall mean the Surveyor for the time being of the Council.

“Heavy traffic” shall mean the transportation of any vehicle (drawn by any animal or animals) which with its load (if any) is of greater weight than four tons for each pair of wheels by which such vehicle is moved, or eight tons in all, and shall include any sledge traffic.

  1. It shall not be lawful for any person, without a special permit in writing from the Surveyor first had and obtained, to take upon the bridge any heavy traffic.

  2. It shall not be lawful for any person to take any traction, portable, or other engine on the bridge hauling any trolly, wagon, or other vehicle carrying a load of grain, machinery (not being working plant), or goods of any description, which trolly, wagon, or other vehicle is with its load of a greater weight than four tons for each pair of wheels on which it is moved, or eight tons in all, unless the tires of such trolly, wagon, or other vehicle are at least 6 in. in width, or the front and back wheels of each trolly, wagon, or vehicle do not track.

  3. No traction, portable, or other engine hauling more than three trollies, wagons, or other vehicles for carrying loads shall be taken upon the bridge.

  4. No traction, portable, or other engine shall be taken on the bridge whilst any other traffic, either vehicular or of live-stock, is on the bridge.

  5. Every engine while upon the bridge shall be moved at a uniform rate of speed not exceeding two miles per hour, and shall not stop on the bridge to take in water, or for any other purpose or reason whatsoever except the safety of other traffic upon the bridge.

  6. No person shall deposit cinders or ashes on the bridge.

  7. No person shall ride, drive, take, or propel any engine, vehicle (whether drawn by horses or not), or motor-car upon the bridge between the hours of sunset and sunrise, unless the same has attached thereto a lamp so constructed and placed as to exhibit a white light in the direction in which the engine, vehicle, or motor-car is proceeding, such light being sufficiently clear and strong to afford adequate means of signalling the approach and position of the vehicle.

  8. No person shall ride any horse, or drive any horse or other animal drawing a light wheeled vehicle, or propel or ride any motor-car, motor-cycle, or other cycle upon the bridge at a greater rate of speed than six miles an hour.

  9. The driver or rider or person in charge of any motor-car or motor-cycle upon the bridge shall, if requested or signalled so to do by the driver of any vehicle, or any horseman, or the person in charge of any live-stock crossing the bridge, stop such motor-car or motor-cycle until such vehicle, horseman, or person in charge of live-stock, together with such live-stock, is able to pass the motor-car or motor-cycle.

  10. It shall be lawful for the Surveyor or any member of the Council, or any person acting under the authority of the Council, at all times to examine and weigh any machine, lorry, wagon, dray, or vehicle (and the contents or load thereon) which he believes to be engaged in traffic over the bridge in breach of this by-law, and to require from every owner, driver, or person in charge of such machine, lorry, wagon, dray, or vehicle satisfactory proof of the weight of any such machine, lorry, wagon, dray, or vehicle, and its contents or load transported thereon, or of either. If the Surveyor or member of the Council or any person so acting as aforesaid shall be dissatisfied with the proof so offered, he may require the owner or driver or person so in charge as aforesaid to drive or convey such machine, lorry, wagon, dray, or vehicle and its contents, together with the horse or other motive power attached thereto, to the nearest accessible weighbridge available for use and capable of weighing the same, and there have the same weighed.

  11. No person shall mark or disfigure the bridge, or climb on or make mischievous use of the same, or any part thereof.

  12. No person shall conduct any traffic on the said bridge until the same has been officially declared open for traffic.

  13. Every person who shall refuse or neglect to produce such proof as aforesaid, or who shall furnish false or misleading information as to any weights which he is required to furnish by this by-law, or who shall refuse to drive or convey any such machine, lorry, wagon, dray, or vehicle or its contents or load to such weighbridge on being so required as aforesaid, or who shall conduct or drive, or cause to be conducted or driven, or be in charge of any traffic on or over the bridge, or any part thereof, in breach of this by-law, or who shall commit any other breach of the provisions of this by-law, shall for every such offence be liable to such penalty not exceeding £5 as the Court inflicting the same in its discretion may think fit.

  14. This by-law shall come into force and effect fourteen clear days after being published under the Counties Act, 1908. Dated at Loburn this 7th day of June, 1912.

The common seal of the Chairman, Councillors, and Inhabitants of the County of Ashley was hereto affixed by authority of the said Council this 7th day of June, 1912, in the presence of—

DUNNE’S DRAW-CRAMP COMPANY (LIMITED).

At an extraordinary general meeting of the members of the above-named company duly convened and held at Dunedin on the 10th October, 1912, the following extraordinary resolution was duly passed:—

“That it has been proved to the satisfaction of this meeting that the company cannot, by reason of its liabilities, continue its business, and that it is advisable to wind up the same, and accordingly that the company be wound up voluntarily.”

And at the same meeting WILLIAM THOMAS MONKMAN was appointed Liquidator for the purposes of such winding-up.

THE EMPIRE PICTURE COMPANY (LIMITED).

IN LIQUIDATION.

Notice is hereby given that at an extraordinary general meeting of the EMPIRE PICTURE COMPANY (LIMITED) held in the Chamber of Commerce, Christchurch, on Monday, 7th October, the following resolution was passed:—

“That it is proved to the meeting that the company cannot, by reason of its liabilities, continue its business, and that it is advisable that it should be wound up.”

At the same meeting Mr. HENRY A. GLASS, of Christchurch, Accountant, was appointed Liquidator.

THE COMPANIES ACT, 1908.

A. HYDE AND WAIPA BREWERY (LIMITED).

At an extraordinary general meeting of the members of the above-named company duly convened and held at the registered office of the company at Te Awamutu, on the 30th day of September, 1912, the following extraordinary resolution was passed, viz.:—

“That it has been proved to the satisfaction of the shareholders that the company cannot, by reason of its liabilities, continue its business, and that it is advisable to wind up the same, and accordingly that the company be wound up voluntarily.”

And after the passing of such extraordinary resolution A. J. BRAY, of Te Awamutu, Public Accountant, was by ordinary resolution of the company appointed Liquidator for the purpose of such winding-up.
