for the license hereinafter mentioned. Such application shall set forth—
(1.) The name and address of the owner;
(2.) The description, the maker’s name, and the maker’s number (if any) of such traction-engine;
(3.) The weight of such traction-engine;
(4.) The weight of fuel and water necessary for its propulsion.
Such application shall be accompanied by a license fee of £5, which shall be returned to the applicant if license is refused. Such application shall be in such form as the County Clerk shall prescribe.

For the purpose of satisfying himself of the truth of the matters contained in such application, the County Clerk may cause any traction-engine to be examined by any competent engineer or other person.

Upon being satisfied of the matters contained in such application, and upon payment of the prescribed fee, the County Clerk shall issue a numbered license under his hand, to continue in force for one year after the date of issue; but such license shall not be delivered to the applicant, or have any effect, until the provisions of clause 7 hereof have been complied with in respect of such traction-engine.

Every licensee who may desire to transfer his license shall make signed application to the County Clerk for a transfer, and upon production to him of such application and of the license which it is desired to transfer, and upon payment of a fee of 5s., the County Clerk shall note such transfer on the register, and indorse a memorandum thereof on the license.

Every person in charge of a traction-engine engaged in propelling the same upon any road within the county shall exhibit the license for the same, upon request, to the County Clerk, or to the Engineer, or to any person authorized by the Council in that behalf.
Security for Damage.

Every owner shall, before the issue to him of a license, give security, to the satisfaction of the County Clerk, that no special damage will accrue to any road, bridge, ferry, or ford which shall be under the care, control, or management of the Council, by reason of the transportation of the traction-engine in respect of which such license is issued. Such security shall be by bond in such form, and with or without securities, as the County Clerk may require in a sum not exceeding £50; provided that in lieu of a bond the applicant may deposit, to the entire satisfaction of the County Clerk, a sum not exceeding £50.

No person in charge of any traction-engine shall propel, or cause the same to be propelled, along or over any road or bridge of the county unless the engine shall be accompanied by two men at least, part of whose duty it shall be to keep a constant look-out, both in front of and behind the engine, for horses, stock, or vehicles, to warn the drivers or riders of the same of the proximity of the engine, and to assist them in passing the engine in safety.

Every person in charge of any traction-engine as aforesaid, upon being signalled by the rider or driver of any horse, stock, or vehicle to stop such engine, shall forthwith stop the same, and if it shall appear that the rider or driver of any horse, stock, or vehicles meeting or overtaking any such engine shall have difficulty in passing the same, every person in charge of such traction-engine shall forthwith stop the same and render all possible assistance.

No person shall propel any traction-engine or cause the same to be propelled upon, along, or over any road or bridge in the county between sunset and sunrise, unless the engine shall carry as a signal a red light, showing both in front and behind.

The whistle of a traction-engine shall not be sounded for any purpose whatever, nor shall the cylinder-tap be opened, or the steam blown off or allowed to attain a pressure such as to exceed the limit fixed by the safety-valve, within sight of any person riding, driving, leading, or in charge of a horse or stock upon a road.

The driver of any traction-engine shall give as much space as possible on the road for the passing of other traffic.

The speed of any traction-engine shall not exceed five miles an hour along any road, and three miles an hour through any township or village, and shall not exceed two miles an hour whilst crossing any bridge or culvert.

No traction-engine, or carriage or wagon attached thereto, shall come upon or pass along any bridge at any time whilst any person with a horse or horses, or carriage, or vehicle drawn by horses, or with stock is on or about to come upon such bridge; nor shall any traction-engine, or carriage or wagon attached thereto, be permitted to stop on any bridge or culvert for the purpose of drawing water from any water-race, stream, river, or ditch passing under or through such bridge or culvert, or for any other purpose whatsoever except for the safety or convenience of other traffic thereon.

While any traction-engine, or carriage or vehicle attached thereto or connected therewith, shall be travelling along or upon any bridge, culvert, or road no detachable studs or other pieces, or rings of iron or other metal, shall be attached to or raised upon the level of the faces of the tires of the wheels of any such traction-engine, carriage, or vehicle for the purpose of which shall have the effect of sinking into, gripping, or breaking the surface of any bridge, culvert, or road.

It shall not be lawful for any person to take any traction-engine on to, over, or across any bridge within the county, unless and except such traction-engine is separated from any carriage or vehicle which may be attached thereto or connected therewith by properly constructed towing-irons not less than 7 ft. in length, and unless there shall be a like distance between every such carriage or vehicle.

It shall not be lawful to take any traction-engine, or any carriage or vehicle propelled by, attached to, or connected with any traction-engine, upon or over any bridge or culvert within the county the weight whereof with the load thereon exceeds 2½ tons for each pair of wheels.

It shall not be lawful to use, propel, or employ upon any road within the county any traction-engine, or to attach thereto, or to connect therewith for the purpose of carrying goods and material of any kind, any carriage or vehicle, unless the tires of every wheel of such traction-engine, carriage, or vehicle are of a width of not less than 6 in.

If it becomes necessary to discharge any cinders, ashes, or other refuse from the furnace of any traction-engine on any road or the sides thereof, such cinders, ashes, or refuse shall immediately thereafter have all fire therein completely extinguished, and such cinders, ashes, or refuse shall forthwith thereafter be spread out on such road or the sides thereof in such manner that such roads or the sides thereof shall be kept even and the level thereof maintained; provided always that no such cinders, ashes, or refuse shall be discharged on any bridge or culvert, or upon any road or the sides thereof within 5 chains of any bridge or culvert.

The person in charge of any traction-engine shall give immediate notice to the County Clerk or the County Engineer of the county of any damage or injury done by such traction-engine, or any carriage or vehicle attached thereto or connected therewith, to any road, fence, bridge, culvert, watercourse, drain, side ditch, or any other thing appertaining thereto respectively; and if such damage has rendered the road, fence, bridge, culvert, watercourse, drain, side ditch, or any appurtenances thereto respectively dangerous to traffic or to public safety, the person in charge of such traction-engine shall, in addition to giving such notices as aforesaid, place such signals in such positions as the County Clerk or County Engineer shall direct, and shall maintain such signals for such time (not exceeding forty-eight hours) as the County Clerk or County Engineer may direct.
Prohibited Months.

No license issued under this part of the by-law shall be deemed to authorize the employment of any vehicle in heavy traffic during the months of May, June, July, August, September, and October.

Clauses of the by-law relating to license fee on heavy-traffic vehicles generally shall apply to traction-engines licensed under this part of the by-law.

Every person guilty of any offence against the provisions of this part of the by-law shall be liable to a penalty not exceeding £5 for every such offence, and if such offence is a continuing one shall be liable to a penalty not exceeding £5 for every day on which such offence continues.
NO. 4 BY-LAW.—WINTER BY-LAW.
- Every person who shall at any time between the 1st day of May and the 30th day of September (both inclusive) in any year drive, use, or employ, any vehicle, whether plying for hire or not, upon any road under the care, control, or management of the Council in contravention of any of the clauses of the First and Second Schedules hereunder written respectively, commits an offence, and shall upon conviction thereof be liable to pay a fine not exceeding £5 for every such offence.
