THE REWA DAIRY COMPANY (LIMITED), (IN LIQUIDATION).

N OTICE is hereby given that at an extraordinary general meeting of the above company duly convened and held in the Public Hall, at Rewa, on Wednesday, the 17th day of July, 1912, the following extraordinary resolution was duly passed :—

“ That it is proved to the satisfaction of the company that the company cannot, by reason of its liabilities, continue its business, and that it is advisable to wind up the same ; and that WILLIAM HAYDON-MACLEAN, of Hunter-ville, be appointed Liquidator for the purposes of winding up the affairs of the company.”

AKITIO COUNTY COUNCIL BY-LAWS.

P UBLIC notice is hereby given that the following by-laws were made by special order by the Akitio County Council, the following resolution to make the same having been passed at a special meeting of the said Council held on the 18th day of May, 1912, and confirmed at a subsequent meeting thereof on the 6th day of July, 1912 :—

“ That, in exercise of the powers conferred on it by Part IV of the Counties Act, 1908, the Akitio County Council hereby makes by special order by-laws to be called the 1912 By-laws, and to come into force on the date of gazetting, in pursuance and exercise of the powers vested in it by the Counties Act, 1908, the Public Works Act, 1908, the Motor Regulation Act, 1908, and every other Act or authority enabling it so to do, and to repeal the by-laws of the said Council made and passed on the 24th day of March, 1905, and entitled No. 2 By-law.”

1912 BY-LAWS.
INTERPRETATION.

  1. IN these by-laws, Nos. 1/10, if not inconsistent with or repugnant to the context,—

“ The county ” means the Akitio County as constituted under the Counties Act, 1908 :

“ The Council ” means the Akitio County Council :

“ County Clerk ” means the Clerk of the Akitio County Council :

“ Road ” or “ public road ” means any road, street, thoroughfare, or way of a public nature or used by the public as of right, under the care, control, or management of the County of Akitio :

“ Public place ” means and includes every road, street, footpath, footway, court, alley, or thoroughfare of a public nature or open or used by the public as of right, and every reserve and place of recreation or resort so open or used :

“ Footpath ” or “ footway ” means a space formed or set apart on the side of any road or street, or elsewhere, for the use of foot passengers, or which is generally used by foot passengers :

“ Chairman ” or “ County Chairman ” means the Chairman of the Akitio County Council who has been duly appointed at an annual meeting :

“ Heavy traffic ” means—

(a.) The transportation of any vehicle, engine, or machine which itself, or together with any thing or things being transported thereon, weighs more than one and a half tons avoirdupois to each pair of wheels ;

(b.) The traction of any vehicle or thing by means of bullocks, notwithstanding that such vehicle or thing may separately or together with any load thereon weigh less than one and a half tons avoirdupois ;

(c.) Any traffic which may from time to time be declared to be “ heavy traffic ” by Order in Council :

“ Traction-engine ” or “ engine ” means a locomotive usually propelled by steam or other generated motive power not being used on a railway or tramway :

Words importing the singular number include the plural, and words importing the plural number include the singular, and the words importing the masculine gender include the female :

“ Firewood ” means every kind of wood (whether dry or green) of a nature or class ordinarily used in New Zealand for the purpose of fuel :

“ Vehicle ” means and includes every kind of conveyance, with or without springs, drawn or propelled by animal, mechanical, or any other power :

“ Pedlar ” means and includes any trader who travels on foot from place to place with a pack, basket,

wheelbarrow, truck, or other vehicle, drawn or propelled by manual labour only, for the purpose of selling goods, merchandise, or wares excepting bread, meat, fruit, vegetables, dairy-produce, or temperance drinks :

“ Hawker ” means and includes any trader travelling with a horse, mule, or wheeled vehicle drawn or propelled by such animal or by any artificial power for the purpose of selling goods, merchandise, or wares, excepting bread, meat, fruit, vegetables, dairy-produce, or temperance drinks :

“ Horse ” means and includes any stallion, mare, gelding, filly, colt, or foal :

“ Cattle ” means and includes any bull, cow, steer, heifer, or calf, and any ram, ewe, wether, or lamb.

MEMORANDUM.

Nothing contained in these by-laws, or any of them, shall be held to relieve any person from any liability to which he may otherwise be subject by law in respect of injury done or damage caused by excessive weight passing along or extraordinary traffic on any road.

OBSTRUCTING OFFICIALS.

  1. No person shall obstruct, or attempt to obstruct, any official of the Council in or about the execution or exercise of any duty, power, or authority given to him by any provision of any by-law herein contained. Any person acting in breach of this clause commits an offence, and shall upon conviction thereof be liable to a fine not exceeding £5 for every such offence.

NO. 1 BY-LAW.—PEDLARS AND HAWKERS.

  1. No person shall trade or carry on business within the county as a pedlar without being duly licensed. Every person who shall trade or carry on business as aforesaid shall be deemed and taken to be unlicensed, unless he shall prove the contrary by the production of his license or otherwise.

  2. A pedlar’s or hawker’s license may be granted by the Council to every applicant for such license approved by the Council, and every such license shall continue in force for the space of six months from the date of granting thereof.

  3. A copy of every such license shall be entered by the County Clerk of the Council in a book to be kept for the purpose and to be called “ The Register of Pedlars’ and Hawkers’ Licenses,” and to be open to inspection by any person during office hours.

  4. Every person licensed to trade as a pedlar or hawker shall be bound to produce his license whenever called upon so to do by any person authorized by the Council in that behalf.

  5. There shall be paid to the County Treasurer the following fees :—

For every hawker’s license … … £ s. d.

  1. Any person acting in breach of this by-law commits an offence, and shall upon conviction thereof be liable to a fine not exceeding £5 for every such offence.

NO. 2 BY-LAW.—GRASS-SEED.

The Council, in pursuance of the powers and authorities vested in it in that behalf, and by section 142 of the Public Works Act, 1908, do hereby make the following by-law relating to grass-seed :—

  1. No person shall cut grass for seed or any other purpose on any road within the county without the previous consent in writing of the Council. Any person acting in breach of this by-law commits an offence, and shall upon conviction thereof be liable to a fine not exceeding £5 for every such offence.

NO. 3 BY-LAW.—TRACTION-ENGINES.

License.

  1. It shall be an offence for any person to cause or permit, or to be knowingly concerned in causing or permitting, any traction-engine to be used or propelled, or to stand upon any road within the county, unless such traction-engine shall have been duly licensed under this part of the by-law; provided that no traction-engine licensed under the heavy traffic by-laws shall pay any license fee under this part.

  2. The owner of every traction-engine within the county shall, on or before the first Monday in January in each year, or upon bringing such traction-engine into the county, make application, in writing under his hand, to the Clerk
