Recreation Reserve in Canterbury Land District brought under Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of July, 1912.

Present:

His Excellency the Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of the Public Reserves and Domains Act, 1908, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Canterbury Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act; and such reserve shall hereafter be known as Beckenham Domain, and be managed, administered, and dealt with as a public domain.

SCHEDULE.

BECKENHAM DOMAIN.

ALL that area in the Canterbury Land District, known as Lots 165 and 166 and parts of Lots 2, 3, 4, 5, and 6 of Rural Section 49, containing by admeasurement 11 acres 1 rood 24 perches, more or less, situated in the Sydenham Ward of the City of Christchurch, and being all the land comprised in certificate of title, Vol. 254, folio 264 (Canterbury).

Whitebait-fishing in Hawke’s Bay.

At the Government House, at Wellington, this twenty-second day of July, 1912.

His Excellency the Governor in Council.

WHEREAS by section five of the Fisheries Act, 1908 (herein termed the said Act), it is, amongst other things, enacted that the Governor may from time to time, by Order in Council gazetted, make regulations which shall have force and effect either throughout New Zealand or only in such waters or places as are specified in the regulations for the purpose therein specified:

And whereas it is expedient to make the regulation hereinafter set forth with respect to the taking of whitebait in the Provincial District of Hawke’s Bay:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation.

REGULATION.

  1. WHITEBAIT set nets having an opening of not more than 8 square feet may be used in the rivers and streams in the Provincial District of Hawke’s Bay. Such nets may be stiffened with wire hoops fixed on poles placed in the rivers and streams.

Withdrawing Land from the Operation of the Kauri-gum Industry Acts.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of July, 1912.

His Excellency the Governor in Council.

WHEREAS by section thirty-three of the Kauri-gum Industry Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may by Order in Council declare that land set apart under the said Act as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the said Act, and thereupon the land shall cease to be a kauri-gum reserve, and shall be dealt with by the Land Board as ordinary Crown land; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary:

And whereas the Land Board of the Auckland Land District passed a resolution recommending that the portion of Opoe Kauri-gum Reserve Extension No. 2 described in the Schedule hereto be declared to be no longer subject to the said Act, and such resolution was duly gazetted and publicly notified in accordance with section nine of the Kauri-gum Industry Amendment Act, 1910: And whereas no objection has been received to the said proposal:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the Kauri-gum Industry Act, 1908, and section nine of the Kauri-gum Industry Amendment Act, 1910, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Opoe Kauri-gum Reserve Extension No. 2 described in the Schedule hereto shall be no longer subject to the provisions of the Acts aforesaid.

SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 20 acres 3 roods 26 perches, more or less, situated in Block V, Opoe Survey District, and being portion of Opoe Kauri-gum Reserve Extension No. 2, set apart by Order in Council dated 10th July, 1899, and published in the New Zealand Gazette of 13th July, 1899, page 1302, commencing at a point 1065646·7 links north and 707096 links west of Mount Eden. Bounded towards the south-west, north-west, and north-east by other portion of Opoe Kauri-gum Reserve Extension No. 2, bearing 333° 2′ 1756·9 links, 42° 8′ 432·9 links, 64° 11′ 623·9 links, 118° 17′ 346·8 links, and 163° 30′ 1759·6 links respectively; and towards the south-east by road to Houhoura, bearing 250° 20′ 913·9 links: be all the aforesaid bearings and linkages more or less: as the same is delineated on the plan marked L. 1416/24, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red. Vesting Land in a Maori Land Board under the Provisions of Part XIV of the Native Land Act, 1909.

ISLINGTON, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second day of July, 1912.

Present:

His Excellency the Governor in Council.

WHEREAS by section three hundred and fifty-two of the Native Land Act, 1909, it is enacted that, on the confirmation of any such resolution as is referred to in paragraph (a) or paragraph (b) of section three hundred and forty-six of that Act, the Governor may, if he thinks fit, by Order in Council vest the land affected by the resolution in the Maori Land Board of the district in which the land is situated; and the land shall thereupon become subject to Part XIV of that Act, and all the provisions of that Part shall apply thereto accordingly, in the same manner as if all of that land had been set aside for leasing in the case of a resolution within the said paragraph (a), or for sale in the case of a resolution within the said paragraph (b):

And whereas by a resolution within the said paragraph (b) of the said section three hundred and forty-six, passed by the assembled owners and duly confirmed by the Tairawhiti District Maori Land Board, it was resolved that the land set out in the Schedule hereto be vested in the Tairawhiti District Maori Land Board under Part XIV of the said Act: And whereas it is expedient that the said land should be so vested:

Now, therefore, in pursuance and exercise of the powers in this behalf vested in him by the aforesaid section three hundred and fifty-two, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby vest the land specified in the Sche-
