apply in any case where a local authority having control
of a road or street declares that the provisions thereof
shall not apply to any specified road or street, or any
specified part thereof, and such resolution is approved by
the Governor in Council:
And whereas by subsection two of section one hundred
and seventeen of the Public Works Act, 1908, it is, inter
alia, provided that such approval may be either absolute
or subject to such conditions as the Governor, by Order
in Council, thinks fit to impose:
And whereas the Wellington City Council, the local
authority having control of that street known as Watt
Street, Wadestown, described in the Schedule hereto, did,
on the twelfth day of March, one thousand nine hundred
and twelve, by resolution declare that the provisions of
the said section one hundred and seventeen should not
apply to the said street: And whereas it is deemed ex-
pedient that such resolution should be approved, subject
to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Act,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
approve of the said resolution, subject to the condition
that no building or part of a building shall at any time
be erected on either side of the said street within a dis-
tance of thirty-three feet from the centre-line of the said
street.
SCHEDULE.
ALL that street in the City of Wellington, known as Watt
Street, Wadestown, commencing at its junction with
Rhodes Terrace, and proceeding in a north-easterly
direction, being a distance of 26 chains, more or less; as
the said street is more particularly delineated on the plan
marked P.W.D. 31723, deposited in the office of the
Minister of Public Works, at Wellington, in the Welling-
ton Provincial District, and thereon coloured red.

Prescribing Close Season for Oysters at Albatross Point,
Urenui Stream.

At the Government House, at Wellington, this twenty-
second day of July, 1912.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is provided by the fifth section of the
Fisheries Act, 1908 (hereinafter called “the said
Act”), that the Governor may from time to time by
Order in Council makes regulations which shall have force
and effect either throughout New Zealand or only in such
waters or places as are specified in the regulations for,
inter alia, prescribing a close season for oysters over any
term not exceeding three years, and before the expiration
of such term further extending the same:
And whereas it is desirable to prescribe a close season
for oysters, over a term of two years, in the waters and
places hereinafter described:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by the said
Act, and of all other powers and authorities enabling him
in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion,
doth hereby make the following regulations.
REGULATIONS.

A close season for oysters for a term of three years
from the date hereof is hereby prescribed within all the
bays, estuaries, and tidal waters on the west coast of the
North Island of New Zealand lying between Albatross
Point on the north and the mouth of the Urenui Stream
on the south. -
Any person committing a breach of the foregoing
regulation is liable to a fine of £1 and not more than £20.

Recreation Reserve in Auckland Land District brought
under Part II of the Public Reserves and Domains
Act, 1908.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
second day of July, 1912.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
BY virtue of the powers and authorities vested in me
by the twenty-sixth section of the Public Reserves
and Domains Act, 1908, I, John Poynder Dickson-Poynder,
Baron Islington, the Governor of the Dominion of New
Zealand, by and with the advice and consent of the Execu-
tive Council of the said Dominion, do hereby order and
declare that the reserve for recreation in the Auckland
Land District described in the Schedule hereto shall be
and the same is hereby brought under the operation of
and declared to be subject to the provisions of Part II
of the said Act; and such reserve shall hereafter form
part of the Hukerenui Domain, and be managed, adminis-
tered, and dealt with as a public domain by the Hukerenui
Domain Board.
SCHEDULE.
ALL that area in the Auckland Land District, containing
by admeasurement 10 acres, more or less, being Section 53,
Block VI, Hukerenui Survey District. Bounded towards
the north by Section 51, Block VI, Hukerenui Survey
District, 1272 links; towards the west by the aforesaid
section, 472 links; towards the north-east by a public
road, 92·5 and 79 links; towards the east by Section 8,
Block VI aforesaid, 1037·4 links; towards the south by
Section 8 aforesaid and by Section 4 of Block VI afore-
said, 1372 links; and towards the west by Section 4
aforesaid, 700·4 links: be all the aforesaid linkages more
or less: as the same is delineated on the plan marked
L. 1285/20A, deposited in the Head Office, Department of
Lands and Survey, at Wellington, and thereon edged red.

by admeasurement 7 acres, more or less, being Section 64,
Block III, Alton Survey District. Bounded towards the
north-east by a public road along the bank of the Waiau
River, 1900 links; towards the south-west by Section 63
in the said block, 1280 links; and towards the north-west
by a public road, 1080·8 links: be all the aforesaid link-
ages more or less: as the same is delineated on the plan
marked L. 1497/1, deposited in the Head Office, Depart-
ment of Lands and Survey, at Wellington, and thereon
bordered red.
